I am active duty and have an Ohio driver's license. I just made a permanent change of station (pcs) to AZ. I am buying a new suppressor, but the guy at the shop says I need an AZ driver's license or ID card in order to do the paperwork. I'm not so sure this is true as I am legally a resident of AZ because I am stationed here. Has anyone had a similar experience? Can anyone clear this up for me?

I am trying to avoid getting an AZ driver's license because I'm afraid I'll have to pay taxes on our cars to register them here.

Re: Active Duty, buying a can where I'm stationed...?

I just had to show my mil ID and PCS orders, in NC when I got my can. I did mine through a trust if that somehow makes a difference.

Also just because you have a DL for one state that does not mean you have to register your vehicles in that state. I have had my vehicles registered in KS the entire time I have been in the military and will continue to do so since I am still a resident of KS evne though I am also a resident of NC for other purposes. Not trying to get too deep here, but you are technically a resident of AZ and wherever you pay taxes to on your LES.

If you don't have the license just provide a copy of your orders. That what I always did when I was stationed in Tucson.

That's what I thought. Im not doing mine through a trust, unfortunately. The guy behind the counter said he's not the best resource for class 3 info at that shop, but he said that the sheriff wants to know where the can will be located, i.e. he wants u to have an AZ license or AZ ID card with your local address on it. I'm gonna call the shop tomorrow and talk to the guy who handles the class 3 stuff for them.

From http://atf.gov/regulations-rulings/rulings/atf-rulings/atf-ruling-2001-5.html:
18 U.S.C. 922(t)(1)(C): IDENTIFICATION OF TRANSFEREE
A member of the Armed Forces on active duty is a resident of the State in which his or her permanent duty station is located, and may satisfy the identification document requirement by presenting his or her military identification card along with official orders showing that his or her permanent duty station is within the State where the licensed premises are located.

So your orders will satisfy the residency requirement from the ATF's point of view.

You can also talk to your finance office on base/post, but I don't think getting a state ID card while keeping your out of state DL would end up changing your home of record for tax purposes.
Not having to deal with CLEO sign offwas one of the main reasons I went with a trust in the first place.

Re: Active Duty, buying a can where I'm stationed...?

Your military ID, PCS orders, and (if required) your lease prove you are a resident for NFA purposes.

If you live on-base your Law Enforcement Officer is the Provost Marshal, otherwise if off-base it's the local police chief or sheriff.

If you use a trust and you ever PCS/ETS-EAS/retire you may need to establish a new trust in the state you're headed to.

Re: Active Duty, buying a can where I'm stationed...?

As it turns out, the Sheriff's office requires some form of photo ID in order to verify where the NFA item will be housed. The shop only needs my orders and military ID. So, I will be getting an AZ ID card and the problem should be solved. Thanks for the help everyone.

Re: Active Duty, buying a can where I'm stationed...?

I am looking at getting another suppressor and am stationed in AK. My trust was established in KS. So, is a trust only state specific? Recommendations, advice?

Thanks

I bought mine here in AZ, stationed at Davis Monthan, and I am a CA resident. Just had to use my orders and military ID I believe.
