Look up any firearms YouTube 'news' channel. The judge obliterated the whole thing, even going as far as ordering the ATF to send letters of 'correction' to those people that were sent 'the other type of letter' previously. AND the ATF is required to return all previously confiscated triggers to their rightful owners.
 
Good decision. Well, *good* in the sense that summary judgement was granted for dismissal to the plaintiffs, but it's still under the APA and not on 2nd Amendment grounds. I'm sure these morons at the Justice Department will try for an appeal.

MGs will always be harder because NFA34, GCA68 and FOPA/Hughes are all legislative - the only thing that this grants in addition to Chevron, to my non-lawyer mind - is stopping ATF from random rule making, or at least blunting their efforts.
 
Which (in the opinion of an autistic welder) is a big deal. Not what we ultimately are looking for but helps to put an end to the bureaucrats constantly moving the goal posts

WOW. I'm on page 28 of the decision right now. This judge is laying a smack down on the ATF. Judge is citing Susan B. Anthony cases as well as James Madison's writings in the Federalist Papers about what a de facto tyranny could be.

I wonder, I know this case was brought on APA grounds, but I have to wonder if Chevron played a part in the ruling. If it did, the judge would state so in his release wouldn't he? Anyone who's read it, is there any mention of chevron in there?

The judge addresses that Chevron shit specifically and says ATF was wrong in trying to pull a chevron style administrative review shit.

With all due respect, anyone on a youtube channel is full of shit until proven otherwise. Many of us believe NOTHING on the internet, so an official ruling is much appreciated. I don't want a talking head going apeshit. I want the facts.

Vacating the ATF's unlawful rule is the same effect as a nationwide injunction.
I'm just being picky here, but no it's not, it's better. Vacating the rule is making it disappear as if it never happened. Injunction leaves it on the books, but cannot be enforced. Small difference, effect is essentially the same.

I saw a ad where there was some parts sold to make the frt selectable. While I am for the devices and the right to own one, I don't think I am stepping into that arena myself. I am happy with Geissle.

Most reputable channels (although inserting a lot of opinions and conjecture) will have the ruling or source material in description.

One thing about leftists is that yeah, they are wacko and they are just as prone to eating each other, but these motherfuckers vote and devote an awful lot of time to rallies, petitions, and whatnot. We need to be upping our game. Remember, A LOT of Castle Doctrine and Right To Carry legislation was passed during the Obama presidency. That is because concerned citizens realized that securing Patriot leadership at the local community level is just as important as everything else. Keep on TRUCKIN'...

Sounds like the appeal is already filed. Plus the AFT say they can’t possibly return the almost 12,000 seized triggers to their rightful owners in the timeframe ordered by the judge.


So, of the 100,000+ FRT's and WOT's sold.... they were only able to get approx 12,000 which includes inventory from manufacturers.

There's still plenty out there 😛

Man, you take all those crazy numbers of "in circulation", and "recovered"; from things like the pistol brace debacle, solvent traps, frames/receivers, etc., and it sure seems like "In Common Use" should soon start to apply......🤔
