922r compliance?

Coincidentally, I ran into this statute while researching for an article and most websites will post the law and basically say good luck, at least in my experience. I called the manufacturer and the CS agent wasn't even aware they put the statute language on their website, but according to them, even though the firearm was imported I had nothing to worry about. That seemed dubious so I tried calling a couple other manufacturers and dealers but literally got no where, so basically I gave up asking. That being said, I ran across some forum posts that essentially laid out that at that time no one had been prosecuted under 922r for failure to comply.

The advice I'm putting in my article is to research the 922R statute and make good decisions.
 
922r also deals with imported firearms and the number of foreign parts allowed on them when they are imported into the country, which is 10. As an example, if you have an imported firearm and use an imported high capacity magazine that's equivalent to three parts on the list, that's bad/non-compliant. To be compliant in order to use high capacity magazines you'd have to swap out foreign components for US made ones to bring the number of imported parts back down to 10.
 
Sleep peacefully at night, do the research and build it up with enough USA based parts to make it all legal.
It's usually not hard, and then you won't have to worry about the remote possibility of trouble.

Some of the better parts resellers know their stuff and will tell you all the parts you need to buy from them to make it compliant.

For example these guys that sell upgrade parts for the Benelli M4 clearly tell you all the stuff you need to be legal and what to buy from them:

Does it count that I have been called to US Customs at airports to inspect and/or audit dozens upon dozens of importers for this 922r Federal Law violation?

Single offense is punished by up to 10k dollars and 10 years. So in retrospect that on average it would only cost about 100$ difference between foreign made vs USA made parts for compliance...it seems like a no brainer but that is not the case lol.

Also--I would not listen to forums in regards to nobody has ever been charged because if you ask most forums there has never been a gunsmith charged by DDTC for failure to register/comply with ITAR.

Note:
922r ONLY deals with semi auto rifles or shotguns......hint: 3 key words there....semi, rifle and shotgun :)

Imported as a pistol is the best way for importers and manufacturers to be safe.

Have I read it correctly that 922r doesn't have the same 'intent to manufacture' that NFA rules do? So if you have a compliant firearm and some parts that aren't installed to hand that no rule has been broken?
 
In the days of cheap parts kits availability I always wondered about 922r compliance parts that weren't marked US or anything else to distinguish from unmarked, original, import parts.
 
Am sure if you got caught on some other charge and they found you had non 922r compliant firearms in possession they are throwing the book at you. Its a law, which means if you break it, you pay. Discovery of non 922r is not easily done visually, but like i said you get your guns seized etc they will surely inspect them and if non compliant then you wished you were.
 
Like above, all I can say I cover your ass...HAVE DOCUMENTATION (and TWO more copies stored securely elsewhere)

Rules can be bent ........regulations .....best to be followed......law=follow it ........federal law= don't even think about possibly skirting in any way, form, or fashion
 
How do importers get away with the SKS. It has 12 listed parts.
The SKS qualifies as C&R and can be imported as all foreign made. 922r applies if it is then altered from this, original as imported, state.

And, the law specifies the max number of imported parts as 10, not how many us made parts must be present. If you change one part, you must replace enough that the total number of foreign parts is 10 or fewer.
 
Ok, I've got a 922r question. If they guy that shot up the Federal building in Dallas were carrying a US made AKM and 5 Russian made magazines, would he be 922r compliant? A mag counts as 3 parts. 5 mags would be 15 parts...
