A decorated Marine veteran facing a mandatory three years behind bars on a gun charge will not be going to prison, after New Jersey Governor Chris Christie stepped in and commuted his sentence Friday.

Marine Sergeant Hisashi Pompey's conviction stands, but the penalty is gone. Additionally, a full pardon remains under review.

"Oh my God, oh my God, oh my God, this isn't April Fools, right?" he said, when we told him the good news. "I don't know how to react. I'm grateful, grateful."

As we told you exclusively earlier this week, Pompey was fighting for his freedom after his arrest. Now, he won't have to serve a single day in prison.

"This issue has now turned over for the better," he said. "And we're going to recoup and, just, oh my God."

Pompey said this decision allows him to not only get back to his life, but also to continue pursuing his engineering degree at the University of Maryland.

"I just said, from the bottom of my heart, thank you," his wife said. "It's like you've given us our life back."

To combat gang violence, New Jersey lawmakers several years ago tacked on mandatory sentences for gun-related offenses. And even though Pompey's firearm was legal, it wasn't registered in New Jersey. The law has been updated to exclude service members, but it didn't apply retroactively to Pompey's case.

Pompey served his country over three tours of duty in Iraq and Afghanistan, for which he received medals for bravery. He also has a beautiful wife and young children, who were facing the prospect of him leaving them for different reasons than before.

"We're all humans," Pompey said. "Humans make mistakes."

Six years ago during a visit to New Jersey, Pompey was at a Fort Lee nightclub when his friend got involved in a fight and grabbed Pompey's gun out of his holster and carried it into a confrontation with police.

No shots were fired, and the friend was arrested. But so was Pompey.

While his gun was legally registered in Virginia, he had no New Jersey permit and was charged with unlawful possession of a handgun.

"I'm not a troublemaker," he said. "I don't cause trouble. I don't do anything bad. It was just a common mistake that I made."

Pompey had lost an appeal and was set to surrender to authorities next week, meaning his only hope was with Governor Christie, whom Pompey had petitioned for a pardon.
"Only help I am asking for is from the governor, that's the only one," he said. "Everyone from judges to lawyers say the only person who will help me now is the governor."

Attorney Evan Nappen had said it's an absurd waste of taxpayers money to put Pompey behind bars, accomplishing nothing while ruining a good man's life.

"He goes into state prison next week, where he will do three years minimum before he could even get parole," Nappen said. "This is a man who has done two tours in Afghanistan, a tour in Iraq. The only hope is for Governor Christie to exercise his power of pardon. Governor Christie in the past has stepped up and helped worthy individuals, and it's my hope and prayer that he does the same for Sergeant Pompey."

Because his weapons charge fell under the state's Graves Act, the judge had no discretion in the sentencing.

The only good Christie has done in this state has been pardoning stupid gun charges like this. One occurred in my town. While the cops did their job following the laws on the books, it's the actual laws that are ridiculous and over reaching. Good for this guy.

Did you read the article . Brought a concealed gun to a bar without a permit . Friend got in a fight and pulls it then gets into it with the police . Illegal in many states to carry without permit , go into a bar with a gun , consume alcohol while in possession of a firearm , brandish/menace with a firearm , and for the Grand Finale got into it with police while in possession of firearm . Oh yeah , all of the afore mentioned are crimes , Commit a crime with a hand gun . These are the laws that are not enforced and on the books that we bitch aren't enforced . It does not matter that the gun was legal cause all the other shit wasn't . The fuck stick that just shot up the school in California had been arrested but not charged due to a firearms complaint just to name one of several different arrests . If said fuck stick had been charged then this might not have happened . Better yet why not ask some of the LEO on here how they feel about having to come up on a couple of drunk 2 year olds in men's bodies whom are in possession of firearms and chose to be argumentative if not combative with said LEO's . Yeah total feel good story .

You want to link the article you read. From the article I read, it looks like the only crime he committed, was his gun was registered in his home state and not New Jersey. None of what you mentioned are crimes, if the gun was pulled in self defense, the party was under the legal limit for alcohol. "Getting into it with police" what does that mean. Seems you don't know from your final comment, but you assume its a crime. Why?

Frankly, the only thing the man is guilty of is not reviewing NJs gun laws before coming here. An oversight indeed but 3 year mandatory sentence worthy? Negative. He's a victim of overbearing and ridiculous firearm restrictions in NJ, which we'd all like to see change.

This gentleman can not be held responsible for the actions of his friend either. That is a completely separate issue that according to the article was dealt with.

As much as I dislike our governor, he's been pardoning people throughout his term that have gotten caught up in these laws. As an LEO, the more concealed carry by good people, the better. I'd love to see people with that freedom but unfortunately it won't happen.

he had the 2nd ammendment plus i think it said his friend grabbed the pistol not him. if he was gay he could have gotten married in either state and that is not even a right, why the hell cant his rights transfer from one state to another? The people that say his rights are not transferable use the same arguments the slave holders used to keep slaves in some states but not others.

Stag , you're ok with someone carrying in a bar , carrying concealed without a permit when it is illegal in your state , drinking while in possession of a firearm , getting into a confrontation with police while armed ? " and carried it into a confrontation with police . " Also I know for a fact that it is illegal in N.J. to transport other than directly to the range and back home if you do not have a carry permit . Several of the aforementioned are definitely crimes and Jersey has a minimum sentencing law on crimes committed with a handgun . So I fail to see any point you are trying to make other than you don't like Christie . As for any comments on what is legal in N.J. I am not a Jurist in N.J. The point that I made in my previous post in this thread is that a series of bad/illegal decisions caused this and that these are the laws on the books . I for one do not see that he should have had a commuted sentence . The original post stated that while visiting New Jersey he did this . With the exception of Law Enforcement I think that if you don't perform due diligence and cross a state line with a firearm you may be in for some accountability . I may not agree with some of the laws on the books and if I violate one I am responsible not the stupid law . I am responsible for me .
And for clarity I was a Sworn voluntary Adjunct of the Juvenile Courts . As for I don't know from my final comment the original op stated that the man " carried it into a confrontation with police " . Illegal possession , it did not state and it would be illegal if here were openly carrying while in confrontation with police , read as Brandishing/Menacing , possibly disorderly conduct , public intoxication . Confrontation speaks to disagreement and I don't think it a stretch to see failure to comply in there . And yes everything other than carried it into a confrontation with police and illegal possession is reaching for something that is not there . Not unlike your contentions .

Im not agreeing with NJ law but one man is not grounds for nullification.
 
since when is it illegal to carry in a bar? No mention of that restriction in the BOR. the fact that the NJ cops didnt shoot his friend dead tells you he didnt threaten them with the gun. I talk to cops every time they pulle me over with two pistols on me, sometimes 3, they never bat an eye and thank me for telling them when I do tell them. A Unconstitutional Law is not a law at all.

First, had he taken his pistol with him today to NJ, it would be perfectly legal as he was a US Marine Military Policeman, they're now covered under the universal carry same as a federal law enforcement officer. At the time of the offense though, MPs weren't covered under that. The simple fact the prosecutor/DA didn't drop it in 2013 when that federal law went through speaks to their personal politics getting in the way of what is right.

Second, I have yet to see where he actually had the weapon on him inside the club. Lots of "retrieved it from the holster", but nothing saying where said holster was and anything further is pure speculation. Holster in the car? At 4 o'clock under his uniform (which he was wearing at the time)? If someone can find that, I'd appreciate the clarification.

Third, who in the fuck outside these socialist states in New England actually have "licenses" for their handguns? I keep seeing this mentioned, the "it was licensed in his state of Virginia" comments in these articles. I own several handguns purchased in six different states over the years and even live in Virginia now, not a fucking one has a license. I have a concealed carry permit, a drivers license, and my lady has a license to practice in her medical field, but nary a firearm of mine has a "license" outside the Bill of Rights. The closest I came to a handgun "license" was in North Carolina, the fake ass southern state it is, where you have to apply to the Sheriff's office for a handgun permit that they take their sweet as fuck time processing until the very last day they legally can.

Fourth, minimum mandatory sentencing belongs to the realms of rapists and murderers, not shit that should be a misdemeanor at worst, and realistically should be perfectly legal and Constitutionally protected in the first fucking place.
