What do you expect from vile judges that are nothing but progressive plants, that is the big problem with our system currently, when the judges get away with totally twisting & ignoring the constitution, settled cases & the laws of the land to further their agenda it kind of makes the entire idea of civilized rule of law a bit pointless.
On the positive side time seems to be handing Trump the chance to fill dearly departed seats in the circuit courts.
On the down side the establishment, an alliance of two party's that make a show of acting in opposition, are firmly dedicated to stopping anything Trump does........and to his peril he doesn't throw a shit fit and start putting his foot in some ass.

be careful with settled law rules, they are creating a lot of settled law that s absolutely unconstitutional. the courts have lost any moral standing they ever had to "interpret" our law under our Constitution. I see no need for the courts anymore, justice has become unjust and illegal.

Because years ago they stopped actually teaching history and noone is sure what the constitution says. They promote giving stuff to people who don't deserve it. When I went to school, the story of the ant and the grasshopper made sense. Now, I'm informed the ant must give his shit to the grasshopper or face government repercussions. When personal responsibility disappeared, so did common sense.
They teach history still it’s just not the truth. This is why the created the DOE. That way they can control the message from birth. Repeat a lie enough times and eventually it becomes truth. I mean we still teach that Columbus discovered America. Never mind that the Vikings and the templars were here long before him.
Our legal system is based on lawyers showing prior precedent in settled cases. With 240 years of prior decisions, a clever lawyer can select cases that support their arguments even though they are often 180 degrees from the intent of the law.

The Second Admendment is written in such a way that the liberals can make a case over “well regulated militia” when anyone who has read the writing of the founders, especially Jefferson, knows full well they wanted citizens to be armed and ready to thwart any infringements or injustice by the government. And that we should have weapons comparable to the government’s (and criminals’) is obvious. This stuff should be laughed out of court in a healthy society.
The founders never imagined that 3-4% of the country would be in the legal profession, siphoning off 20% of the GNP like the parasites they are.
We need lawyers but only a few of them. We should burn down 3/4 of all the law schools, it would cut down all this frivolous BS.

Frankly, I've often wondered why our legal system puts so much emphasis on precedent. It's easy and lends itself well to a process, but I can't see how it offers a correction if a previous error occurs. Could you give me a word or a name for that sort of system so that I can read up on it more? I appreciate you naming the "Napoleonic" alternative. It'll give me something to chew on.

Attempts at squashing or selectively funneling human vice and virtue, speech and thought, is a perennial game of despotic whack-a-mole that is expensive for both the national purse and psyche. Our cilivians are are much better trained and armed than ever before!! People that have never owned firearms have gone out and made the purchase. Time will tell but I believe we are coming to standing point very soon. I ask because you're operating under the assumption that military weapons are inherently superior to civilian versions. Spoiler alert- they aren't. Ever heard about the lowest bidder? My issued rifles were ragged out pieces of shit.
Tanks, aircraft, cruise missiles, etc have almost no value when dealing with an insurgency. It takes men on foot with small arms. Men who are outnumbered, fighting an enemy they can't see.
We couldn't control Iraq or Afghanistan, we damn sure can't control the continental United States.
It's not just about metering force. They have superior ISR capabilities...we have nothing more than ham radios. They can communicate more effectively and can bring firepower to bear where it needs to be. That is a huge advantage that shouldn't be discounted.
Agreed that when the bullets start flying, they may not have as large an advantage but ISR wins the day for the most part

In any event, the military simply doesn't have the numbers to effectively occupy even a fraction of the country. They can have all the communication capabilities in the world, but that only matters if there's someone on the other end who can get there in time to help.
The US is 15x larger than AOs where the Taliban operated.

I suspect “ number stations” will be a great way of hiding messages should there be a ‘ civil war’ type event.....especially on the HF bands....where determining the country of origin is really difficult
You may be correct but HF can't always be counted on due to atmospherics. Ionospheric bounce is required and relatively large power amplifiers. Not to mention the ginormous antenna. I have worked on OTH systems in the 2-30 MHz band...not easy and rather archaic compared to todays methods
Whatever resistance Americans would make would be divided. After all the coastal cities are in the hands of the liberal establishment regardless. What would most likely happen is we'd divide into Red and Blue independent entities and maybe unite under some sort of commonwealth arrangement after 10-20 years of bullshit skirmishes.
It'd be more like that protest in Oregon a couple of years ago, guys in pick up trucks in stand offs with the Feds. Shoot a few people on each side, rally around some injustice or massacre, fight and bloviate but in the end most people have to get back to work and make a living.
But eventually they would realize they need the Midwest and Mountain people's food and resources while the Red States would still need trading partners and porn. In fact this is how we should probably organize ourselves anyway, without the violence at all. I'm currently in a Blue state but ultimately I would migrate out, in a generation we'd be fairly stable.
The other scenario is we simply stop paying taxes, delivering food and resources, and cut off power/water and escape routes from the big cities. If 10 million Republicans do that the Liberals mostly die and go away. It'd be very extreme but ultimately the working class holds the real power. I don't think Chuck Schumer could plant a crop and Nancy Pelosi can't drill for oil.

Would you like to be assumed guilty of whatever crime you were charged with unless YOU could prove you are innocent?
Would you like your freedoms to be at the whim of someone filing a single unsubstantiated complaint?
Would you like it if after you fight your court case and win, the prosecution can haul you back to jail over and over as they appeal your innocent verdict up the courts for years on end?
Would you like the courts to have the option to just not have a jury and do whatever the judges decide themselves?

Would you like your freedom of speech to be subject to only allowed if nobody is upset by what you say & the government agrees with it?
The reason Legal precedent is given a lot of weight is because just about always the laws are written either broadly or poorly & fine edges and exact circumstances have to get nailed down. Once those are hammered out in courts, generally they are left sit so that everybody has an idea of what to do without having to fight each case over and over again. Stability in how laws are applied and interpreted is rather important to having a stable society.
While our legal system is pretty messed up, it is like the constitution, messed up because people let it become corrupted by greedy and power hungry people & over the years refused to eliminate those that corrupted it.
In my opinion there needs to be some significant changes.
Possibly make it much easier to remove judges that become partisan actors.
Get back to a strict interpretation of the constitution in the original English grammar without all the "shall not be infringed but....." common today.
Seriously pare back the "power" judges claim for themselves, and restrict them to only being able to order things after a trial by jury.
None of this "contempt of court" BS holding people for ever and ever as punishment at the judge's whims.
Curtail frivolous lawsuits by instituting looser pays rules & throwing out with predjuice lawsuits.
Eliminate Jackpot justice in civil courts, institute realistic limits on monetary awards based on actual facts, not how many millions can we award the lawyers.
Require criminal conviction before you can do civil suits based on a supposed criminal event.
Eliminate all monetary compensation from verdicts to the court or local government, so ALL proceeds fines/fees/costs/seizures/confiscations/takings, in TOTAL from any case involving the criminal or government civil courts, get sent back to one big federal pot that then gets divvied up evenly each year 2% to each state's general education fund.
Get rid of the "Puritan" elements of our justice system.
Get rid of the abomination of using "Tax Law" to control possession of things as a crime
Get rid of our fixation on harsh punishment and vengeance style laws (especially when another person was not harmed), in favour of trying to make it possible for a person who has done wrong to compensate and repay the injured party & go back to having a productive / useful life without the only possibility being a life on the margins of society where repeated criminal activity is the only real option.
While our legal system has many issues, I would strongly suggest a long hard look before you rush to somebody else's system.
As rotten as ours has become, it does still offer more protections for innocent people than most others.
If all our so called militias were battle hardened from centuries of fighting the British, the Russians, Americans and each other then we would have something. Our militias are no Taliban. I have been around them seen them and no thanks. I consider them the first wave of the walking dead.

Gotta admit you're right. I just read about this topic yesterday so it's fresh in my mind but I've only read one editorial, not really thought it over or learned much.
Your points make a lot of sense to me.
What little I know is anecdotal, like that poor American girl in Italy accused of killing her roommate... and the Italian justice system being ridiculous in the extreme.
To get back on topic a little, since the logic of this ruling was that "military" grade weapons aren’t protected, does that mean my m9 bayonet can be banned? How about my beretta 92fs (m9 pistol), or my sig p320 (m17)? Are those open to bans as well?
Yes the absolute pussification of America. The quicker we accept what we have to work with, the quicker we can start planning for the hand we are soon to be dealt.

I found it irony for someone to think that standing off against tyrannical government means to fight head on till the very last man. Look at the Vietnam War, where Asymmetric Warfare (Guerrilla Tactic) was utilized by the Viet Cong, and see how that turned out. You can ask any Green Beret and they'll tell you how that works. Keep in mind, unlike any oversea conflict, very single kill counts because we are both American, and we fight to change public mind, not to bring extinction to each other.
