Yeah, they pulled it for reasons other than his DWI. They already knew about that before they let it air. They pulled it because of the outrage at his hypocrisy that it got. The DWI is just a convenient excuse.

Correct me if I'm wrong, but a DWI charge would have to be because of his blood alcohol content being over the legal limit. One can be charged with a DUI if their blood alcohol content was under the legal limit, but driving erratically.

Isn't that the way it works?

In some states if under a defined thresh hold the order can be "release forthwith" but.........

The charge does not go away.

The officer has to testify the additional observations that gave probable cause to charge DUI.

Usually a case may be dismissed prior to trial on the OUI or if the facts of the case indicate impairment a person can be impaired if even below the statutory limit.

There are 1/2 beer lightweights out there as well there are two case professionals that can still operate.

Shit in MA an illegal was able to commit vehicular homicide while OUI and his lawyer got the judge to slap his wrist because as a "central American indigenous" his genetics did not allow his body to process alcohol like a westerner........this despite dragging a motorcyclist under his truck, running over him twice trying to clear the bike from under the truck, leaving the scene, having his kid in the truck with him and drinking from a just bought case.......dont for a second think the law applies equally.

Alcohol is not the only substance you can be charged with being under the influence of. If you take a hand full of pills and chase it with 1 beer its probably not the beer affecting you.
 
Not sure in what states, but I know for a fact a refusal of a PBT will get you a guilty charge in AK. Also says he blew a .02, but doesn't say how long that was after he was arrested.
