To clarify the way the annual April 15th "Tax Day" GEMTAX Promotion works, an end-user buys one of the four qualifying models from his dealer between April 15 and April 30. Everything is unchanged as compared to a normal suppressor transaction - the only difference is, instead of sending the completed Form 4 to the NFA Branch, it is sent to Gemtech.
This is where the June 15th deadline comes into play - we must receive the end-users application (Form 4) <span style="text-decoration: underline">before</span> it is approved, not <span style="text-decoration: underline">after</span>. There should be plenty of time to get a Form 3 to a non-stocking dealer, if that's necessary, and a Form 4 application signed by local CLEO, fingerprints done, etc., before June 15th deadline. We had hundreds of people take advantage of the promo last year, even with a few backorders we honored, and no one missed the deadline (<span style="font-style: italic">other than three guys that apparently didn't read the instructions <span style="text-decoration: underline">at all</span> and sent them over four *months* late...</span>)
When the Form 4 application is received at Gemtech, we then establish that it is, indeed, a qualifying silencer purchased within the promotion time-window, and we write a $200 check to the BATFE which is sent along with the customer's Form 4 to the NFA Branch for processing.
There is no rebate or check sent to either dealer or customer, no difference in pricing on the product, etc. - we are simply offering to pay your entire tax for the transfer. It's an idea I came up with to be Gemtech's way of hopefully bringing some cheer to the clients, helping new shooters take the plunge into NFA ownership, and a big giveback time for those that just want get away from some of the negativity that's prevalent in the suppressor community and just get out and enjoy some suppressed shooting.
So timeline:
Qualifying model bought from dealer between April 15 and April 30
Form 4 application received at GEMTECH prior to June 15
End-user gets an email/postcard that we received their Form 4.
We pay the tax for that transfer, and UPS it off to NFA for processing.
End-user gets an email/postcard when it is sent to BATFE.
Dealer received approved Form 4, just like always.
End-user picks up approved suppressor, goes shooting and enjoys life.
As news of our promotion goes around the various boards and whatnot, things can always take on a life of their own, people misrepresent or mistake points, so I'm taking a rare moment to step in and make sure people don't make any embarrassing mistakes.
