The problem is he was not acting in self defence when the crook was in the neighbours house not his. I know it's a stupid distinction but that seems to be the reason in this case. Police will not take the responsibility of adjudicating the law at the time. They want to leave that to a court to decide .
Here in OZ You don't have any rights to defend another persons property or even your own property outside of your home or other buildings that make up your home.
You can't shoot at someone for stealing your car off the driveway. However if they break into your garage to steal your car while you are occupying the garage you can show a threat to your person , but you wait till they are in first.
