Came across some .308 loaded with M2 AP pulls at a fun show today and wondered about their legality. Did a search online and found all sorts of conflicting info. Some say that like the SS109, M2 is not banned. Others say it is not banned because of the weight of the penetrator is sufficiently light in comparison to the overall weight of the bullet, other say it is banned if loaded in a .308 case but not a 7.62x51 case (because .308 is a pistol round but 7.62 is not). Others posted pics and load data of M2 heads in .300WM, .30-06 and .308. I have seen the pulls and loaded ammo sold online so what gives?

Go or No Go? Federal law or banned State by State?

If I remember correctly, AP ammo isn't banned for use in rifles, you can purchase, and load it, and shoot it in rifles. The big no no is when you use it for pistols.

That being said, the only AP available on the market these days is either surplus .30-06 loaded ammo, or the same round, but they've pulled the bullets and are selling the bullets only.

SS109 is technically armor piercing by definition of the ATF, but it has some sort of exception, and is allowed for civilian distribution.

ATF laws are confusing to begin with, lots of "this is, but that isn't" thrown in there.

No restrictions that I am aware of for AP in rifles. Since most rifle rounds will penetrate soft armor and most light caliber (.30) AP rounds will be stopped by Level IV armor it's a moot point.

AP ammo in pistol calibers is restricted.

As always check your state and local laws.

asked the same question to my state police buddy, here in pa, they are illegal in 308, thanks to the assholes at thompson center making a 15" "pistol" barrel in 308, so im guessing since they make a 3006 and 300wm barrel in pistol length that they are also illegal in those calibers
