MA finds homeowner NG in firearms self defense.

I thought for sure the execution shot was gonna convict him
Here's the homeowner on cross-examination:

Testimony (at about 29:20) is that after the first shot, homeowner and the girlfriend are outside, girlfriend is on phone with 911, and through the girlfriend, dispatcher is asking for the about-to-be-dead-guy's present condition.
Homeowner goes back inside to check for 911 and sees the other guy getting up.
Homeowner shoots again and manages to hit other guy in the head.
Homeowner sounds like he was well-prepped by his attorney.

They do that here all the time. A few years ago they tried a guy who shot the moron stealing his work truck and $50K in tools. The tweaker turned and pointed his cell phone like a gun, the homeowner shot him once on the dome, he died and crashed. 200 or so previous arrests, they charged the homeowner with murder.

The police claimed the guy was fleeing in the stolen truck, cops said he was going 55 mph when he was shot. The fully loaded GMC 3500 was about 75 feet away when he fired. I gave the defense lawyer an acceleration program. It would require several thousand horsepower to make the 10,000 pound truck reach those speeds.

I also gave him a link to more than 100 police reports where cops shot a guy for using a cell phone as a gun from the previous three years. And donated to his defense. Cops fucking lie. They had congratulated him on a good shoot, several of the responding officers had known the scumbag for years as a frequent flyer and were happy to see him gone. Then they all testified for the prosecutor about how this evil man shot him for no reason.

This guy did the world a favor by killing this scumbag.

I was wondering what thoughts would be on the "controversial" facts of the case.

911 should never advise anyone, "Go back in and check on the dude that was just trying to kill you."

Sure if you begin first aid after a shoot that looks good and is perhaps the right thing to do, but if you had a fifteen minute fight and had to use your firearm to comply with M. Stanley Dukakis order that you "flee your house" in the face of a threat......than maintain the guy secured in the home and the cops can go in and check on the dude.
 
This is why you do not give a recorded statement until you have had 1-2 days to calm down and process the information. When the police show up, provide them the basic facts and point out the evidence that you see or know about, such as brass on the ground.
