Damn that’s crazy if he really popped him again after the shit bag was already dropped on the ground.

If the good citizen thought the shooter was still a threat, he is justified in firing again. Was the guy moving? Reaching for another gun? Maybe making a move to grab a knife or get up and attack?

"I was moving in to render aid and the robber moved in a way that made me fear for my life and lives of those around me." Who knows what really happened in that last couple of seconds leading up to the final defensive shot.

I'll tell you one thing, if I was the shooter, the cops would have to find me. I damn sure wouldn't be walking into a police station and hoping some shithead DA wouldn't hit me with some bogus charges he will spend the next 4 years and $100,000 trying to defend.
I’ll bet not, this isn’t left wing Austin. There has been enough support for “the defender” that if there is an indictment, I expect many gun lawyers in Texas will offer their services pro bono. Not to mention an expected go fund me page.

I'm sure that's true, but right now there are no charges and he has no obligation to turn himself in. Coming forward cannot yield a single positive result.

I'd just be another D.B. Cooper. They could make documentaries about him in 40 years and speculate who he might have been.

That did not work so well with the 1/6 guys. In today's world they just look at who's phones were where and the myriad other ways they have to track those they really want to fuck.

I live in a small town with 1 stop sign and 4 churches. But I work in Dallas. 2020 and 2021 during the mostly peaceful protests where people were being shot in the street and buildings burned (luckily, that did not happen in our area,) my secondary carry was my Windham Weaponry Dissipator M4 A3 and 600 rounds carefully concealed here and there. Like I said, that was my secondary. My primary is my M&P 9 mm and then, I was carrying 1 full mag in, 1 in the pipe, 2 more loaded mags, and another 200 rounds, a lot easier to conceal.

Never needed it and I don't look for trouble. I got home safely each time, doing about 80 up the Sam Rayburn.

Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:

(1) if he would be justified in using force against the other under Section 9.41; and

(2) when and to the degree he reasonably believes the deadly force is immediately necessary:

(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or

(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and

(3) he reasonably believes that:

(A) the land or property cannot be protected or recovered by any other means; or

(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

It worked out OK for him so it's obvious in this case it was the right choice, but I would would not have let that guy get behind me. On his way past he'd have taken the first round. Especially if I saw his eyes were not focused on me.

Looks like his gun was in his jacket not on his side. Making movement to draw attention would not be wise.

Maybe, but for me I would sacrifice stealth for control . Not Monday quarterback. It's the way I would have done it. It worked for him. If the same thing happened to me today he would take the first round in the chest on the way by.
 
Very difficult to know how you’d react in that situation. The amount of Adrenalin coursing through the gentleman’s veins could easily alter one’s sensorium.

Wonder if he ditched the pistol?

Have you ever seen a crime scene after the forensics are done? Since the guy walked away they watched the surveillance video and printed everything he came close to. If he went to the restroom it's covered in black powder also.
Yep. Even better never touch it at all with an ungloved hand. Takes no extra time really and can be a real advantage in a case like this
Between DNA, finger prints, facial photos, doorbell cameras and so on. There's not much that you can get away with anymore
