Reminds me of the time the cops tried to kick in the door of my buddy's house. (Unfortunately for them, due to the drug-related crime in his neighborhood, he had installed an outswing door with a steel jamb.) He drove up while the "super-ninjas" were wailing away with their ram and asked what the hell they thought they were doing. They took him down hard and broke his nose and injured his shoulder in the process. Turns out that the cops had transposed the last two numbers on the warrant and had the wrong address. Oops...

Needless to say, my acquaintance got a nice fat check cut to him (of OUR tax money, of course) to hush up the episode. And of course, the real bad guys just a few houses away were able to slip away.

Not an isolated instance or uncommon occurrence. But then, surgeons saw off the wrong body parts and leave instruments inside people on a regular basis, so guess I shouldn't be surprised that a bunch of less-educated adrenalin-pumped cops can't get the right addresses.

This is sure to get interesting, but hearing the judge apply common sense makes Texas look like a viable choice in my search for a new state to live in.

except that it a FEDERAL judge... that kinda floors me

There is a difference between serving a warrent where time is not a factor in getting the facts straight, and responding to a crime in progress, where comunications can be confusing, and time is limited.
The judge made the right call. The facts of the case need to be heard.
