Short barrel rifle

I bought a LWRC REPR on gun broker the gun comes from LWRC with two uppers a 12inch and an 18inch. I am only getting the 18inch upper and the lower but because it comes from the factory with the 12inch upper the lower is registered as a short barrel rifle. How do I get the lower registered as a long barrel rifle so I dont have to bother with all the class III extra papperwork? thanks

Ryan,

This is bad advice, once a rifle is entered into the NFA registry it is always in the NFA registry. You can amend the registry to state that it is no longer in title 2 configuration. Ask the Tech branch what they will require.

If you transfer a SBR without a Form 3 or Form 4 or ammending the registry (ie making it 16"+ Barrel) YOU are BREAKING THE LAW.

All you need to do is find a stocking dealer that has the 16", 18", or 20" models available. If you opt for the kit then it will have to be sent to a class 3 dealer in which he will begin a transfer to you because of that 12" barreled upper. You can avoid this by getting a rifle only package.

If you have already bought the package then yes your going to have to register it with the ATF/NFA as a SBR. There is no going back unless you clarify with the ATF first. I dont think the process can go from SBR back to 16".

Once the FACTORY registers it as an SBR with the BATFE NFA Branch then it has to be transfered on the appropriate paperwork with taxes paid (if due). No matter what barrel is on it.

You can remove it from NFA status by notifying the BATFE NFA Branch in writing, but until then it IS a title II firearm. Improperly transferring or possessing can result in you being charged with a Federal Crime so make sure you know what you are doing. Talk to a FFL/SOT that deals in Title II weapons. Do not take advice from the Internet.

I was assuming he was buying a Title 1 weapon from the factory. My mistake.

If he can't get LWRC to sell it to him as a Title 1 weapon, he needs to find one in stock with a dealer, have them contact ATF and have it stricken from the registry, and then purchase it as a Title 1 weapon.
