Technical Question for FFL01s Out There !!!

I'm normally well versed in all things that have to do with FFL licensing, and normally have an answer. Although, a buddy of mine came up with a question tonight that I couldn't answer.

My buddy went in to get a new 1911 today, and , as usual, he got delayed. For some reason NICS delays him every time, and he doesn't mind.

So, he paid for his pistol and is awaiting the 'All Clear' or 'Approved' check mark on his Form 4473. It typically takes a day or two before they call back, so he is just waiting for the dealer to call him to pick up his pistol.

<span style="font-weight: bold">Once he is approved and goes to pick up his pistol can he add an additional pistol to the purchase without having to fill out another 4473? ie... add an SR22 to the purchase on the same form.</span>

In that case, would he be better off waiting another week to purchase the other pistol? Does this raise him to scrutiny in the future, or is it just for tracking possible criminal activity?

I tried to do this the other day (two rifles) and the shop made me just fill out two 4473s and they sent it through the internet separately. In a nut-shell, I ended up doing two completely separate transactions. Colorado is weird though, each background check is double checked by Colorado Bureau of Investigations (CBI) before you get final approval (thanks NRA douches).

I don't think it raises any alarms.

the 3310-4 is the ATF/NICS/Brady way they track pistols....supposedly to keep people from buying 20 at a time and selling them w/o paperwork....

I seriously doubt 2 will raise and eyebrow...


now if he did 2 multiple times....

my suggestion is to just fill out the 3310-4 and enjoy his purchases. in my mind, if it's ever looked into, waiting the bare minimum days is a bigger flag

What do you mean? That it implies that there is something in his background or someone with a same name that is questionable?

I think this is allowed. The 4473 instructions specify what must be completed prior to calling NICS, and the section identifying the firearms must be completed afterwards.

Questions 18-20, which includes "Type of Firearm" must be completed before NICS approval, and is reported to NICS by the licensee. Therefore, you could add firearms a long as they are the same type.
