“To avoid dismissal on immunity grounds, plaintiffs would have had to present well-pleaded allegations showing that (1) at least one defendant was not a covered person, (2) some conduct by a defendant was not causally related to administering a covered countermeasure, (3) the substance injected into L.P. was not a covered countermeasure, or (4) there was no PREP Act declaration in effect at the time L.P. was injected.”
In the event of a public health emergency, the PREP Act ensures certain “covered persons” are immune from claims causally related to the use of a “covered countermeasure.”
A vaccine is considered a covered countermeasure.

The point of contention was the parents sued when the child was accidentally vaccinated and the ruling says they have no standing to sue as the govt is immune.

SO the ruling doesn't say the state can vaccinate your children, it says if they 'accidentally' vaccinate your children they are immune from prosecution.justice (which is slightly more terrifying--"OOPS you said not to but we made a mistake!). The PREP Act and this subsequent ruling allows immunity from any "mistakes". The willfull misconduct must be proven and if eventually it ever is, the harm caused is irreversible. You don't like "qualified immunity", TF do you think this is?

When I pointed out that person moved there from a left-wing state, her head exploded. The ruling about a guy not being able to "train with guns" on his own property sealed my opinion about the current state of the state. I saw the same BS from people I knew who moved to PA from NJ...to get away from the high housing prices and taxes of course. You don't like guns?
