    5:17 AM ?..........Hmmmm.........sounds like they wanted to have a confrontation with someone pissed about "someone" banging on their door at that hour. Conversely, I supposed they could make a somewhat credible argument for "protecting others" by choosing that time.
     
    I try to remain quiet about these things, but anyone who doesn’t realize that these “red flag” laws are unconstitutional is actually part of the problem. All states already have laws that allow for the proper due process for serving warrants. These laws not only circumvent the due process of law, they are written so that a complaint or request for firearm removal doesn’t even have to be credible nor is there any way for the public to keep checks and balances on abuse of this sham. This type of law is very much the beginning of the end of your personal freedom, folks.
     
    It will be the new wave of "swatting" but done without fear of retribution.
    You can accuse anyone anonymously & have their rights taken away from them without due process, rather grab now and best have money for a lawyer and the year it will take to get them back.
    That's at best case.
    At worst case the police go in trigger happy and shoot anyone not interested in giving up their constitutional rights over hearsay.

    Letting vile filth "complain" anonymously, is just plain unconstitutional, you have a constitutional right to face your accuser BEFORE your rights are taken away.

    But once again nobody cares that right are taken away or people killed...

    The ERPO's have some restrictions on who can apply for them, so it isn't just anyone. I'm pretty sure it's just significant others, family members and LEO....for now, but there are politicians already saying that needs to get expanded. Over 100 issued in the couple of months since it's passed. Just wait until former girlfriends and neighbors can rat you out just because they can cause you grief!

    This is exactly what you'd expect if you serve an ERPO "no knock" style in a neighborhood that a citizen would be concerned about crime in.

    That said, apparently the guy put down the gun. Was told what they were there for, and then picked it back up. No excuse, but not smart.

    This piece of shit law is sooooo clearly unconstitutional. And our crappy "Republican" Governor signed the thing. Personally I think this went down EXACTLY how the drafters of this law hoped it would.

    I gotta get out of this state...

    Lash, I agree 100% that this law is unconstitutional. Yet today we are in ordinary times, not the end of days, if it were me I would comply under protest. I would not give the state an excuse to murder me just because I was in the right. I would rather be alive and prove that I was in the in court. Or, alternatively stay alive and free to exact retribution from the relative who turned me in.

    But this guys mistake likely started much earlier than this morning. He should have cut those family who were double dealing assholes out of his life years ago. Every time you try to help a double dealing crak head asshole it is going to come back on you.

    Ok, so the Supreme Court has ruled that Law Enforcement has absolutely no duty and/or obligation to protect me, my family, my neighbors, etc....so how can a judge sign a warrant in which LEO serve that is drawn up and executed based on "protecting" me, my family, my neighbors, etc?

    You do not get to be free from the obligation to "protect" me, yet get to take my freedoms from me because you are "protecting" me.....Those are not single lane streets.

    Because of crap like this I buried a nice side folding norinco Ak and 200 rounds before I left for the military. Unfortunately I dug it up 10 years later right before I found myself going through a messy divorce. If she coulda had them try and take my weapons I wouldn’t be here right now.

    That is a very good point. I have a friend who just had to evict someone he had been giving free rent on an apartment to on the condition that that person pay the electric and STOP smoking crack.

    My friend had a nice detached two story garage where he put a bathroom and shower on the first floor and a bedroom on the second floor. His original thoughts when building it were that he could shower after working on his race car before going in the house, then he put a bedroom in the upstairs section for friends of his who came in from out of town for a few races who might otherwise have slept in their car hauler trailers. My friend never got a building permit to put an apartment in his garage. He has a separate electric meter on the garage that this crack head relative of his was supposed to be paying. He opens his mail one day and finds a final shutoff notice for the electric. So he storms in to the apartment and catches the looser smoking crack.

    So he pulls an immediate eviction. Get your stuff in your car, get out, don't come back. Guess how long after that Saturday eviction it was until the building inspector showed up because my friend built an apartment with out a permit?

    Spoiler---It was the following Monday right after lunch. My friend had called me and a few other guys on Sunday and we hauled every stick of bedroom furniture to a dump, and put boxes of plumbing and heating components that my friend used in his business in the former bed room. Sorry Inspector, no apartment there that's just where I store my business supplies. So in the course of 15 minutes my friend went from being the guy who was helping him out too the guy who evicted him for no reason.

    If anybody is listening, never try to help an asshole. If you have assholes for friends, family, or acquaintances get rid of them now, before they need help.
     
    Sometimes you don’t know till you catch em in the act. I got family like that. I distanced myself but my parents would throw them out and let them back in a few months later. It’s hard being cold out of necessity. Not everyone can do it.

    It should be no surprise in a state like Maryland this law passed. I'm not sure why everyone is so surprised this happened. Its not like your average officer is going to stand up and say this law is bullshit and should not be enforced.

    We should fully grasp that a "red flag" law is a simple justification for shooting a gun owner that does not want his/her guns stolen by the local government. I have not seen one line in one of these "laws" that states the gun owner is required to go through a professional evaluation before having their stuff stolen. Where is the gun owners due process? No where. Instead, some disgruntled person can make a false claim, have you approached by as many armed thugs as they deem necessary with the mind set that you are already guilty and leaning toward shooting you because you have a gun. This is tantamount to a deer tag for a gun owner.

    Stuff like this is why you have more guns than you can remember and have totally forgotten where many of them were put for "safekeeping".
    As you get older it seems you don't really need any help to "forget" how many you might have or where they might be.

    They are unlikely to really do a good search, most likely trying to bully you into handing them over, or grab what they can in a smash and grab like your average burglar would, anything they can see, possibly try to get you to open a safe or rip the keys off you if it's keyed.

    But it would help to have some in safe keeping off site or where you can get to them later in case they decide to do a full detailed search.


    However it's all for show, as while a gun is useful, your local cornerstone gas station either with or without a visit to your local hardware store will get you way better equipped to be "a danger to others" than some guns if you are trying to actually harm people not expecting it.

    What they really care about is you not being able to quickly defend yourself when they or their "allies" of Communists jump you by surprise while you are trying to enjoy a nice evening or peaceful night's sleep.

    However even then, if you just go middle ages on them and do some planning with "fortifications".... oh the fun that can be had...

    I am afraid you are correct. No, the man wasn’t smart but at the same time, this seems ripe for abuse in my mind. Why should one be forced to give up their God given rights just because someone stupid calls something in without any actual proof? It’s nkt right and will be abused, possibly used as a justification of murdering those that don’t comply with their masters. At best one gives up their stuff and is robbed then has to spend tons of money in court trying to get their stuff back. That’s robbery and in most cases things will not be returned and if they are most likely will be damaged. If people do not see the problem with this then I don’t know how to help this country. This would just be the beginning. Things would only get worse and worse and once completely disarmed, the masters could do whatever they want to you whenever they want without any repercussions. So, what do we do? That’s not a place I want to live.

    That is what I see as the biggest issue and most effective long term tactic of the "red flag" bullshit. Shoot enough gun owners in the process of serving papers/taking guns and there will be a large number of law abiding citizens that will acquiesce to the thuggery. You might even have some that proactively turn in their guns.

    Things like the MD occurrence are also by anti-2A people to bang the drum about "the crazy, gun loving, fascist conservative that all need to have their guns taken away."
     
    ^the inverse of that is true too. Sometimes determination and a beretta 92 gives tyrants a beating. There are a lot of vet gun owners all out of fucks to give.

    I do not see the upside for Stewart because he is dead, by his own hand. When the dust settled Stewart should not have been charged with ANYTHING. Armed cops kicking your door in should be viewed no differently than thugs doing the same thing. The girlfriend should be charged as an accessory to murder.

    Well, I see a lot more cops not going home at night if they keep this shit up. Eventually that "red flag" will be extended to just about anyone for any reason.

    "It's my job" and that badge ain't gonna cut it when you try and take someone's fucking Rights. But I'm sure there's plenty enough dumb ones and sycophants that they'll be able to find someone to do that job... But I imagine it's gonna get harder to replace 'em over time as Darwin goes to work.

    The next guy will probably be answering the door wearing plates with an M4 FWIW.
     
    Was Stewart dead “by his own hands”? the guy killed a cop then was taken to a cop ran facility.. lots of people who tangle with cops end up dead in prison cells. They are all claimed to be suicide. Anyone accused of killing a cop outta be taken into fed custody at least.
