Long story short, a cop I knew when I was about 13 or so made it super simple: if the woman acts like a man, she gets treated like a man. If she acts like shit, she gets treated like shit. They don't, however, get to act like a man one second, then when retribution comes wanna claim victimized woman.

Yeah, I didn't get that, Sean the Nailer brought it to my attention. I saw the video and read some of the comments on here but didn't know he died. That makes her a callus murderer then.

How about a guy that shoots some home invaders and is now in prison because he defended himself and the perp died as a result? I could just as easily argue that this man didn’t intend to kill the perp, yet one is in jail and one isn’t. There are many crimes which require "intent" and many that require no intent, only "negligence". The Clinton thing was a " negligence" type crime, but also a complete sham not related to this matter in any way, shape, or form. So... intent: if she tracked the old man from his home, followed him on the bus, and waited for the opportunity to push him out knowing he would hit his head and die, that would be 1st degree homicide due to the malice aforethought (a plan, or premeditation = high criminal sophistication and intent)
Intent: If she and the old man got into an argument and she, while in the argument, or just after they became separated, grabbed a pipe that just happened to be there and beat him about the head until he was dead: that is 2nd degree homicide without malice aforethought, rather it is "in the heat of the moment". She definitely meant to kill him, but didn't really have a plan, per se.
Now, could the prosecutor Charge 2nd degree due to the fact most reasonable people know old people are fraile and easily break bones, and direct head trauma like what was caused in this case have a high likelihood of causing a fatal injury??

But, in the real world, The prosecutor charges with 2nd Degree AND 3rd Degree Manslaughter. Her public defender will advise her to plea guilty to the latter charge, and the prosecutor will agree to drop the former charge.
Traffic violations are mostly crimes of omission or negligence meaning you don't need to have intent in order to be in violation. The speed limit is 45 and you're doing 55. You're in violation, period. Your vehicle registration is expired. You're in violation. Your brake light burned out 10 seconds ago, but you have no idea: You're in violation.

I don't like it, Cl custom 1911 don't like it, none of us "like" these facts, but this is exactly how it works. This is pretty much why I said even I could get her charge greatly reduced. Even if I was a lawyer, I wouldn't, which is pretty much why I couldn't be a lawyer.
Now she is already on probation for something, we know that. That will be bad for her, but I still don't think she will get more than 5 years....as I've already said.
It is what it is. She was already on probation? With her behavior, that's not surprising. That said, previous criminal activity will factor in to the sentencing part of the plea agreement as part of the consideration of the aggravating and mitigating circumstances, etc.

I have some experience in this area, because of my inadvertantly interacting with a criminal. I have seen a judge "retain jurisdiction?" In a case. The guy was given probation, but as I understood it, a violation put him at risk of going back in front of judge Martin to face the music.
The dick in this case, was charged with assault on a female, my mother to be exact. My charge in reference to him was assault with a deadly weapon. I was found not guilty. The dick was found in my case (also judge Martin presiding) to be an extremely lucky man.
So....depending on what her previous suspended sentence entailed, she could face more sentencing I suppose.
I can't imagine however that it will be near enough.
