^^^ Agreed - I was considering a TR - no longer if true! (I also stopped doing business with Smith some time ago...)
Guys Support has been overwhelming both Marc & Myself really appreciate it... we can officially say, "worldwide support" in this matter.

We may not need all of it, but the frequently repeating stories of false promises, delays, shoddy work, etc... really help add to the truthfulness and usefulness of the information posted on SH. We have been getting correspondences customers have had with them directly and all this will really help prove the case.

Appears that the Complaint is about to get dismissed by the judge, sua sponte, which means on her own because she noticed a problem with it:

So I have to assume this D-bag is suing you for at least $75k??? He must be, because that is the minimum amount needed to sue in federal court due to diversity of citizenship. This is obviously not a federal question. I hope you can countersue, and put these hacks out of business
Pretty sure he is just repeating what they sent me in 2010 when they threatened to sue me in Federal Court back then.
The letter was from a different lawyer, but it seems to be very similar, other than adding Marc Soulie into the mix.

This is not a super secret Federal lawsuit so the Parties involved as well as the plaintiff's council is public knowledge.

I read the complaint and, as much as I believe that the life of every lawsuit is sacred, unfortunately for it this poor tortured infant was born on life support.
It looks like it's got some procedural hurdles to overcome before it even gets in the front door of the courthouse.

I don't know how much the plaintiff's attorney is charging in this case, but if it was me I would want to talk about renegotiating the fee.

Also I probably wouldn't mention that a colleague decided that they didn't want to be an attorney any more. It gives the impression that the firm isn't stacked with hitters.

Call me esoteric, besides I haven't left my seat for the last 7 hours and I have grown tired of arguing over money and language for the day.
I'm very glad the "fan boy" syndrome hasn't gotten ahold of this thread. It isn't unusual for a group of "I own one, therefore; they must be worth every penny, maybe more", to chime in on this type of subject. I realize this is more about a lawsuit, and not the quality of the product, nor the price, but nonetheless, the fan boys have stayed silent. I'm guessing there aren't very many satisfied owners of tr's product on the hide.
This is going to turn into a gangbang pretty shortly.
With the amount of people that have literally been robbed by TR.net and the deep set hatred towards them by people who have been lied to and scammed, this is either going to give the defense so much valid proof as to the level of shit TR.net puts out as well as conform in a possible countersuit by all parties involved.
So what do you do? You file a lawsuit against the site where 95% of your potential customers would be, and probably 95% of your past (mostly unhappy) customers are.

There really is power in numbers (think about the reaction to Jim Zumbo when the lardass suggested that nobody needed a semiauto rifle) -- but you and Marc have your hands full, even if this case is a complete debacle for the plaintiff. Keeping it zipped, but sending Kalifornia Bad Karma which a massage therapist friend tells me is stronger than we think. (rolling eyes, but she's hot).

That smacks of delusions of persecution. Unless there was something I didn't notice, this is all made up and delusional; included in the lawsuit in a misguided attempt to silence the forum?
Even if TR's claims (9 & 10) are true, this is a private board, for profit. If the owner wants to allow some advertisers multiple screen names, so what, this is how boards make money. I would have suggested buying some ads, ect.. After watching the "bad out of the box" video, I'm not sure the owner of the Hide has conspired in any way to degrade the TR product, that just takes place on its own, based on the product itself. There are a lot of products that are touted by various groups on the hide, that when one compares their claims to "what the pros use", they aren't to be found! Are there better products? The professionals seem to think so, but they aren't kept from advertising on the hide. I'd suggest that TR have a head to head shoot off, with several of the "favorites" from the hide. Each mfg picking their own shooter, at 600 to 1000 yards, even if the TR rifles don't win, if they are "strongly in the hunt", they may have a more believable claim-then again it may also sink their ship. But with a 1/4MOA, all the time, every time, rifle (as TR claims they produce) winning shouldn't be a big problem!
Seeing as the bar has been set, why can't everyone who has been screwed by this company put together a counter suit and stick it to them?
I don't know why those who have not received any goods for their money don't call the IRS... just in case he hasn't declared the 'income'....

The suit is absolutely ridiculous on all grounds they allege and obviously fighting is the proper course, it just sucks that TR is subjecting the involved parties to this crap.

I have been told on more than one occasion (by more than one attorney) that a law suit does not need merit. It only needs opportunity. I worked for a sizable law firm as a DBA for ten years. Not only did that experience completely destroy what little respect I might have had for the legal system, it soured me on IT altogether. Never again do I want to contribute anything to a bunch of autocratic, self-absorbed pinheads and it's the reason I'm trying to start my own business.

IMO this action is without merit. There is a 5-8 page thread somewhere of endless unsatisfied buyers of Cheaper Than Dirt. Which was active during a time when their advertising banners were prominent supporters of this site. I've seen numerous other examples. Numerous.

Having said that. The fact that this is a private forum is irrelevant and immaterial to this claim.There are forums like this for everything from sewing to quilting, to skidsteers to earthmoving and hunting to this one. Almost all are privately, for profit, owned.
Be it a co-op, a corporation or even a charity. You can't create a space. Be it a internet forum, a billboard, newspaper or any other means to communicate or distribute information or points of view. With the intent of destroying or inhibiting a persons legitimate right to business, a job, or to operate lawfully. Private ownership of SH is not a legal firewall to this claim.
Cabelas, Amazon, etc. all have areas on their sites for reviews of products, books, scopes and rifles. Some reviews are pretty bad. If Cabelas decided for corporate reasons to only allow bad reviews of Leupold scopes in order to only sell its own private label scopes. They might face a claim in the courts.
I have seen product bashing and gun bashing threads get deleted here. Usually its because it degenerated into stupid name calling and personal stupidity. On balance poor products get disclosed to the four winds quickly without a shadow to hide behind. Thats why we are here.
I would never want to see a small business have its legitimate right to existence threatened by another. Or any infringement of commerce by the powerful upon the weak.
IMO the claim is without merit. For the aforementioned reasons.

While it would obviously make sense to submit your problem / info to Frank & Marc, that information may be looked at as being biased or tainted, where info via the BBB make be seen as being from a more impartial 3rd party?

Since i only ever post here. It may be worthwhile for members(here) post on other forums a link about this issue and how to make a donation. I'm surprised that more people don't know about this site and raising some extra $$ wouldn't hurt.
+1. you nailed it. i would also add that i hope this lawsuit ends up being the proverbial 'final nail in the coffin' of tactical rifles and david rooney's business. It would be a great thing if he never 'produced' another rifle or scammed another customer ever again.

Will donate at the end of the week to help the fight Frank. I have never even heard of them till seeing this thread and not impressed at all by their website. The M40 they offer looks nothing like the M40 that GA Precision built me a few years ago. But then again, GAP is a wold class shop and known everywhere you go.

Same here. This is dead before it began though. As this is in federal courts... looks as if the federal judge is already killing it on her own. Even if she doesn't, Rule 12(b)(6) will do it too, "Failure to state a claim in which relief can be sought".... mandates attorney fees in most jurisdictions. They don't have a dog to fight with.

Possible counterclaims would be "abuse of process" or after dismissal, "malicious prosecution". The latter is a pretty high burden to meet though so personally, if it gets shot down right off the bat, give TR the middle finger, publish the orders, and continue as normal around here.
