Not sure how their law is written, but I would bet the funeral home/homes does not have a food service license.

Get a food service license and the problem MAY be solved.

I dont know. Without a food service license, I could see stuff like this being an issue everywhere in the country. Department of Health doesnt mess around(around here at least) with business's serving/selling food without the proper licensing.
 
Honestly who wants to eat at a funeral? Who would request food be served at one?

Every funeral I have attended has been relatively short and to the point.
 
Who the hell appeals these things? A judge threw it out for being unconstitutional then someone said "Man it really pisses me off when there is food at funerals. Rather than not eat it I'll appeal the ruling"
