So if these traffic laws are just of generating revenue why did none of these cops write me up for everything they could? Why did they usually just cut me loose with a warning? I've been pulled over no less than 50 times in VA

Having been stationed in Virginia for four years, I can safely assert that many of the drivers there can't drive for shit and would be dangerous at 20 mph let alone 100.
I took a look at Virginia's traffic code. Anything 20+ over is automatically deemed reckless. Road conditions, traffic density etc... Have no bearing.
A first time offender is typically fined. Repeat offenders spend time in the county hotel.

NOVA drivers are fucked but if you think theyre bad try Austin Texas or Boston Ma.
 
Regardless if you support the law. or lack of, they are there for people who can't seem to make the right choices. If you have anarchist, anti-government tendencies and think none of them should apply to you I wish you luck and break out the checkbook.
As far as the OP's daughter. in most states, 20 over puts it in the reckless category and in some states disqualifies you from taking a driver ed class for dismissal. Don't worry, the insurance company will forgive her after three years. In the interim, I would brace for a pretty healthy fine, depending on the demeanor of the judge.
 
Does she live in VA? Does she live in the same county? The you're not from around here matters in many counties especially southern part of the state. I disagree with it not being a money racket. Just because you got lucky and got off fairly clean doesn't mean that the rest of us haven't been screwed over at some point in an obvious speed trap.

Around here the money flows because they catch enough people coming in hot @ 80-100 in the 45 zones so they would rather throw the book at them than bother with the 10 overs in the 55s. Yes NOVA is a shiftiest when it comes to drivers, and they don't need cellphones or distractions, that just adds to the fun. I'm epecially fond fo the women eating milk and cereal putting on makeup at speed with a cell phone shove in their face. The real fun comes when the traffic lights default to 4 way stop, they become paralyzed by stupidity.

As for Fairfax's speed traps, they hide all over the place not just FX parkway. They're on 66, the backroads of Chantilly and 28. I'm especially fond of them stepping out in the middle of the road showing a hand up to pull someone over in a 55 zone. It's a miracle they aren't seriously injured with the way people drive around here.

As for the OP's question Since she was in theory doing 100 and ticket was written for that, she needs to look at the ticket and see if it's checked for her to just pay the fine and avoid court. If the box isn't checked, she has to appear. Most of the time reckless is an automatic go see the judge in VA. She will likely get a stern lecture and her fines are probably going to run above $1k, if not more.

If it's her first offense and she's clean they probably won't maker her do jail unless she throws a fit. Even if they reduce the charge, they will charge her with something that sounds not so drastic and write it up in the system so her insurance takes a hit. She may not get the full 6 points but that will come with having to do traffic school. If she's had another ticket in the last 12, they might hit her with the full 6 points and suspend her license. Max 1 year in jail, $2500 fine so if she's from out of state get a lawyer and be prepared to pay the lawyer and the court.
 
The situation here is straight forward. The question isn't should an attorney be retained, but who is the best to retain. The facts are straight forward. 100+mph = reckless = misdemeanor charge = possible jail time. If she had to get a credit card to pay the attorney, the interest would more than make up for itself by not having a criminal record for the rest of her life. @jerryrva it sucks for you, your family and her, I get that and understand it all too well, however, be prepared. 85% of cases are pleaded down to a lesser charge, however, in VA either the prosecutor or Judge can order a bench or jury trail however unlikely. I can recommend a highly regarded attorney out of NOVA who teaches other lawyers and judges about the defense of serious traffic offenses. Best of luck to you and your daughter! I do not have the time or inclination to read this entire thread so please excuse if someone already suggested this. One way to get what should be a decent lawyer and make her learn a lesson...make her attend the same court a time or two prior to her court date with the goal of seeing which lawyers seem to be getting good results and use one of them. This way you get the protection she needs, and she has to do some work, all while watching others deal with the repercussions of their fuck-ups.
Generally the best lawyers for a particular traffic court spend a lot of time working in THAT court with THAT judge and have the best relationships with THAT prosecutor
