Is a ak receiver with a AK-74SU parts kit installed, with a folding stock, SANS pistol grip a SBR? Barrel length at 10.5" with overall length of 28.5" with stock extended.

If it has any form of attached stock and the barrel is less than 16in it is considered an SBR...The grip is irrelevant to the situation. You could just get it registered and not worry about it...SBRs, SBSs, and suppressors you can built your self as long as you do the paperwork first...Dang I accidentally deleted the link to a neat website with all the required ATF paperwork on it...search for ATF forms or something like that and its all in PDF form so you can fill it out on the computer then print it so it looks legit. They also have a general guideline of how to go about the process. I didnt use them for my form 4s but I did use it for the form needed to move your residency or travel with the item...Ill look and try to get back with the info

But you still have to get your finger print cards from the ATF...The only thing that makes there cards special and required is just the little stamp on it. Other than that I believe its just a plain ole' finger print card but if you go down to the police department they will finger print you for 5 bucks on cards with no stamp and if you send that in it will take forever to get your stuff finished. They will put it in a pile to review for a month or two then send it back and you will have to do it again...Sorry im just kinda rambling on now but I hope Ive helped

I don't mean to be cryptic, but lets say I hold a FFL, I received a weapon VERY similar to the one mentioned above to transfer to a individual. I received it from another FFL in Texas that claims it's OK as long as it doesn't have a pistol grip.

It's locked in the safe as per the ATF agents I talked to earlier, for review on Monday.

I'll post more after I talk to the agents Monday.

Yikes!

The pistol grip thing makes no sense. It is whether it has a butt stock. Now, an AR pistol has the buffer tube sticking out the back, but it is not a stock so it is OK. An AK pistol needs nothing out the back.

The FFL that sent it to you is in deep doo-doo. Is he a kitchen table dealer or a regular shop?

For sure play it safe and cover your behind.

Even if it was reg'ed as a pistol when it was born, the stock makes it a SBR, with any barrel shorter than 16". They (BATF-E) will bring a rod, traceable to NBS standards.

Many have learned the law from the inside, and someone will again.

I'll set the story straight after I talk with the ATF Monday. If anything, it's entertaining.

Any chance they will let me destroy it and keep the parts kit?

I doubt it, as they will most likley want the shippers info, and take it with them. If it goes the full route, it will be engraved with a case number, and thrown into a pile with others waiting court action.

So here is waht happened...

I had a guy who asked me to receive for a transfer, a AK-74SU. I know what a 'SU' is, also known as a 'Krinkov' (though thats incorrect), but I didn't think twice about questioning what it was, as I assumed it was either a pistol, or a rifle with an extended flash hider to make it legal. It arrived Friday, and this is what I found in the box after I opened it:

The folding stock is fully functional, built on a milled receiver. Whoever built it knew what they were doing, because it is flawless. From breachface to end of F/H, it measures 10.5", overall with stock extended is roughly 28.5". The pistol grip was not installed, but was included with the gun.

It came from a dealer in Texas. In talking to the buyer, he mentioned that the dealer had taken it in trade or bought it outright from someone in Texas. The buyer picked it up off a well known forum. Apparently the seller said it was OK since it didn't have the pistol grip installed. I can only speculate s to what has happened, but it looks like plan old ignorance of what is a NFA weapon, and what is not. I am not a SOT, but I knew as soon as I took it out of the wrapping it was a unregistered SBR.

ATF was supposed to come tomorrow, but after doing a little research and looking at the pics I sent to another agent, he asked if he could come out today. He took it with him, and told me it would be shipped off to the lab for a determination. He was going to call the buyer to talk to him and let him know he wasn't in trouble, and said someone would be visiting the dealer in Texas to have a conversation. I will eventaully hear from him after the determination, but I highly doubt I will hear anything else besides the weapon was destroyed.

It blows my mind that I received a unregistered SBR from another dealer. I don't know if the guy has a shop or not, but I wonder how long he had it in his possesion?

Seems a shame; you're right it's a nice looking weapon. I'm not sure how I feel about what should happen to the other dealer, I'm sure it will be harsh.

I really didn't want to get anyone in trouble, but I really had no choice in turning it over to the ATF.

I don't have a clue as to what will happen though.
