AR-15 with a 3-Position ambi selector switch in CA

Is it legal in California to install a 3-position ambi selector switch on a AR-15? He'll, Is it even legal to own a 3 position selector switch in California?
The AR-15 is a LWRC M6A2 16" 5.56 with stock BCG and a Geiselle SD3G. The lower has a infinity position for auto fire.
 
IIRC, addition of ANY part from a full auto lower parts kit, weather it makes the rifle shoot full auto or not, constitutes constructive intent in the eyes of the ATF and will get you some unwanted accolades. Many lowers now are marked with something in the 3rd space, this doesnt mean you can use a 3 position selector.
 
As an exercise of pragmatism I would suggest not using it, especially in CA. Just because it might be legal it is most likely not worth risking it, even if you are in the right. It's 100% legal to machine an 80% lower without registering it, assuming you abide by the AWB laws, etc., but to a regular patrol LEO it may look like you are in possession of a firearm whose serial numbers have been defiled ----> you getting arrested. Even though you did nothing wrong you will still have to pay a lawyer to defend you, take the time to go to court, many other hassles. Even if you counter-sue and make some money off of it, is it still worth it? In my opinion the answer is OH HELL NO. Just have to decide what you're willing to put yourself though for what you get for it. Right/legal isn't the end of it unfortunately.
