Your buddy defended himself and his family. I dont believe that is what got him sent to jail. Stabbing the guy 13 times is the issue. Dont get me wrong, in my opinion he could stab the guy 1300 times and it would be justified. But to the law, you are supposed to be trying to stop the threat, not kill the guy. 13 times was excessive in their eyes.

I understand the context to which you are speaking,, but...if it were a small knive (penknife?) and the dude kept moving/fighting... then that could be a reason for such a number.

Right?

Hope Your plan works to help Your friend. I also hope the names of the scumbags prosecuting him are plastered all over the internet. They are just as guilty as the home invaders in My opinion.

Stop the threat? As long as the son of a bitch is in his house, he is a threat till he is dead, or one would think....just not the thinking over there apparently.

iv not heard of this in any of the media . makes you remember what happened in county mayo when the elderly farmer shot dead a traveller(gypsie) that was constantly harrasing him on his property.the laws governing how you can defend yourself on your own property were changed after that , they still are not robost enough in my opinion. in ireland self defence is not a valid reason for applying to licence a firearm , you will be refused and looked at unfavourably on any other applications after that. in my opinion anyone that steps onto your property with intent to burgle or harm you and your family has wavered their right to life, they deserve everything they get when they step onto your property.

Easier said then done.... one person can't make that happen. You would have to have the support of many in your community. Sounds to me like wishful thinking at this day in age.

It's even tougher than that. Sometimes we forget, the USA has open primaries, meaning anyone can run for office for any party in the primary.
In other countries the party chooses the candidates you vote for. This vastly increases the chances of getting no great choice.

To the op, sorry to hear about your buddy. Horrible news.

Not sure if it is the same in Ireland, but the idea of "reasonable" or proportionate force in the UK seems to mean you can use less than or the same level of threat that you face in protecting your property. So if a guy has a gun, you may get away with shooting him (unless, like Tony Martin is alleged to have done) you shoot the bastards in the back as they are running out of the door.....but if he has a hammer and you stab or shoot him you are in the shit.

It's "like for like"....not "he bought a knife, so I bought a gun" that counts - even though both are lethal weapons.

I'm guessing that, in the eyes of the law or the jury at least, "reasonable force" does not include stabbing the shitbag 13 times....even it was with his own knife?

Also, courts usually instruct jurors to ignore any "previous" and deal only with the facts and the case before them.

Not saying it is right (clearly the fuckers got what they deserved) but the idea of "reasonable force" and self-restraint are pretty hard for jurors to quantify - until the day the same thing happens to them!!

I really hope your mate's appeal goes well

Been busy for the last few days.... met his lawyers last week. Believe we have good grounds for an appeal and an initial bail application to get him the hell out of jail... will adviswe shortly on the media blitz....

One thing, if/when you do go public, might suggest looking at making a page on facebook, you dont have to rely on liberal media to get the word out, you can do it on your own.

<span style="font-style: italic"> Irish homeowners can now legally use guns to defend themselves if their homes are attacked under new legislation.

The new home defense bill has moved the balance of rights back to the house owner if his home is broken into "where it should always have been", say top Irish police.

The police association of superintendents and inspectors, the AGSI, stated that “the current situation, which legally demands a house owner retreat from an intruder, was intolerable".





The new bill was published by Justice Minister Dermot Ahern yesterday. Under the bill homeowners will be allowed to use "reasonable" force against intruders to defend themselves, others or their property. This includes lethal force, depending on the circumstances.

Justice Minister Dermot Ahern stated that house owners could use guns in self-defense, especially if the intruders were armed but said it would ultimately be a matter for the courts to resolve.


The bill also clarifies that a house owner will not be required to retreat from an intruder. and that intruders injured as a result of reasonable force won’t be able to sue the house owner.

"The bill is welcomed because it aims to clarify the entitlements of a homeowner when faced with the situation where an uninvited intruder has entered the home," AGSI vice-president Dan Hanley told the Irish Examiner.

"The bill aims to shift the balance of rights back to the homeowner where it should always have been. It is intolerable a homeowner should be compelled to retreat in front of an intruder who has entered the home and who may have malign intentions towards the homeowner, the family or the home owner’s property."

Hanley added: "It is ridiculous to suggest the bill, which attempts to redress a serious legal imbalance, would provide a license to kill or a ‘have-a-go’ charter for homeowners, the vast majority of whom will continue to act with good sense and in a peaceful way."

Minister Ahern also dismissed the suggestion the bill was a "license to kill". He stated it merely allowed for lethal force provided it was justifiable.

Rural Link, the national network of community groups in rural Ireland welcomed the bill, saying it was "sensible legislation giving much needed clarity to homeowners on their rights when confronted by intruders".

The Irish Council for Civil Liberties however, stated it would inspect the bill to establish that it was "human-rights compliant".

The need for new legislation became evident after an intruder, John Ward, was shot dead while on the land and dwelling area of Mayo farmer, Pádraig Nally.


Nally was convicted of manslaughter, but his conviction was later overturned after a public outcry.

Burglaries in Ireland increased from 23,600 in 2007 to 26,800 in 2009. Violent burglaries rose from 255 to 363 in the same period.

Some of you here live in much more rational thinking states than me, in Illinois it's very easy to get your self in the same situation this mans poor friend got in. I know several cops and they have advised me of the laws here. One thing they told me is you never leave the intruder alive, he said they will more than likly sue you, and win, if they live. He also said they have to be inside your house not on the front porch or lawn and have to have a weapon with intent to harm you or your family. If all this criteria is not met, in Illinois, you would be going to jail aswell. I do live near Chicago and the judges may have more common sense in southern IL but up here this is what I was told my several cop friends.

I really want/need to move.
