Suppressors Dealer Closing before Transfer

I purchased a couple TBAC suppressors from a dealer that does not plan to renew his SOT in June. The suppressors just finished manufacturing and will be Form 3'd to him and I have not yet filed my Form 4.

Can the cans simply be transfered to another local SOT and then I file my form 4?

Can you get a another FFL before they ship them? If so, switch FFL's then file your form 4.

He can possess them until the transfer is complete.

I had purchased a can and about 2 months after buying the shop( which was silencer co affiliated) closed. Silencer shop had to get can back , cancel form 4 with ATF and resubmit . When form 4 goes in it has dealer info on it which picking can up from. If I were into the process further and had 2-3 left the shop was going to continue to hold cans before cancelling ffl.. was a Pia but at least silencershop took care of . So they Cannot just change ffl to which it’s going after atf gets paperwork and cash check. Doesn’t work that way

I had an issue with this on my first can and he maintained possession of my can until my stamp got to him.

The SOT is not required for transfer to you, it is only used for FFL-FFL transfers without paying the NFA tax. As long as your dealer maintains his FFL, there should not be any issues.

Even if he has no FFL, it’s still a Form 4 transfer from him to you. So long as the unit is transferred to him before his SOT lapses, it’s fine.

that sucks, a dealer just informed me he was closing his shop and moving to another state and was going to “hand off” my suppressor to another dealer to finish it out. I went with @SilencerShop too.

I was assuming so, I called the other shop that it was supposed to be going to and they told me they are looking into it. I’m not well versed in this, would it be a from 3 to another dealer? I was just hoping it would be transferred and eventually my tax stamp would get sent to the new dealer.

Is your Form 4 already filed? As long as the current dealer still has an active license/SOT, he can transfer it on a 3 to another dealer. If your 4 is already filed, it’s going to be pretty annoying. Whats the actual status of the current dealer, your transfer and when does he move?

My form 4 was already filed, tax stamp check was cashed in September. The dealer that was closing informed me of this in December and I gave it a couple weeks before I called the dealer it is going to. They just let me know they were looking into it. I called again today and left a message so hopefully I’ll hear back. The dealer it’s going to is a SOT dealer and still within the Silencer Shop network just like the last one.

The 4 will clear, unless he manages to get it voided while in process. At that point it’s yours. If he voids it, he’d have to do a 3 and then that dealer would need to submit a new 4. He can ‘close’, but unless he turns his license in he’s still a dealer. If he turns it in, the 4 might fail if they catch what is now an error on the form. At that point, he’d have to do a 4 to someone, it might as well be you. I don’t see anything else to do. There‘s no point in voiding it, and no reason to get another dealer involved.
