Not enough info right now, but looks like a bad shoot on its face. Does deceased have a history of violence? Did the wife/gf have a history of violating the custodial agreement? What's happened in the past when she did? Where was the kid and how was shooter+woman involved? Were they hiding him? Why? Whats the law say about trespassing in situations like this (I'm assuming he has some sort of legal right to be there to get his kid)?

Without knowing anything else, I think SD is a hard sell since shooter left woman outside to retrieve the firearm and didn't point the firearm until he deceased grabbed the gun. If he was thought the threat to persons/property was there, why didn't he have it immediately trained on the threat when he returned?

its really hard to argue you felt your life was in "eminent danger" when you are able to slowly saunter into the house to get a gun, and then leave the safety of your house to confront a retard with your rifle......you are actively putting yourself back into "harms way" intentionally.

the fact that they were both arguing back and forth, and pushing and shoving, without any real punches being thrown, is going to make it hard to argue you saw him as a threat, and that you were not a willing combatant....

at the time he shot him, he was 7-10' away, the green shirt guy was not advancing towards him, and he was unarmed.....
