FFL Transforor will not let me have my rifle!!!

I am have a terrible time trying to pickup my new rifle I purchased from a fellow Hide member and I need to know what I can do.

I paid for this rifle close to a month ago and through some mistake of my own the gentleman I purchased the rifle from would not ship the rifle until my money order cleared his bank. No big deal because I knew the money order was legit so I waited.

Long story short the rifle finally arrives at my local FFL dealer I was there when he opened the box. And he says "we have a problem, theres no FFL papers sent with the rifle". So he refuses to transfer the rifle and now the rifle is just sitting in his buisness and and wont let me have it.

Is he correct should there have to be an FFL form in with the rifle or does he not know what he is talking about? WHAT DO I DO????

There should be a number for your state police ...where they do the background chedks. Callthem for advice. As far as I know an individual can ship to an FFL....some of them choose to only receive from other FFL's but he should have told you that before you ordered the rifle.

All your dealer legally needs is an ID (like a copy of his OL) from the seller.
If he choses not to accept from an individual that's his choice, but it's not a legal requirement.

When all is said and done make sure you politely inform "the owner" of all the problems you had and what he will do to correct them. If it is the owner that did this to you..... Well a bad reputation spreads like wildfire. Do some homework and make sure everyone in your area knows who NOT to go to for firearm related business.

He doesn't even "have" to have a copy of the DL, there's no law stating that unless it's a KY law....not federal for sure. I've shipped plenty of guns to buyers and only about 4 have needed a DL with them. It's a dealer request, not an ATF request.

Tell him to give you your rifle or you're calling the ATF and telling them that an FFL stole your rifle. I'd get a police report started too.

I have no problems with people preferring to do things one way or another, but when they start making up their own laws and holding people hostage I get pissed off.

What type of info did you send with your firearms. The only thing that was in the box was like a letter head with his name and address. But my ffl said thats meant nothing. Starting to sound like to me that my ffl guy just wants to be a dick.

Jason, I stand corrected.

I did a trade with a guy in another state last week. When the gun showed up at my dealer's shop without an OL copy in the box, my guy refused to transfer it to me. I called the guy I got the gun from and he scanned his OL, emailed it to me, and I took it back to the shop and got the gun transferred. The dealer in the state where I sent MY gun said he didn't need a copy of my OL, but it would be OK if I sent one.

So, going by that experience it appears that an OL is not "legally" required, it's the dealer's "policy".

It's a shame you're having such a time. It sounds like your FFL is only willing to accept from another FFL (his prerogative not the law). Hindsight is always 20/20 but you have to have that issue resolved before you have a weapon shipped.

Have you asked your FFL if a copy of the sellers DL will suffice?

I'm guessing that worst case scenario you are looking at having to foot the bill to have your FFL ship it back to the seller and then pay to have the seller ship it to another KY FFL of your choice who will accept/transfer from an out of state individual OR
foot the bill to have your FFL ship it back to the seller. Then pay to have the seller transfer to his FFL who will then ship it to your KY FFL that you have discussed.

I have had to do this same thing in the past (except I scanned/e-mailed mine directly to the FFL dealer instead of faxing). Some dealers have a morbid fear of failing to dot every "i" and cross every "t" even though there is ZERO requirement under the law to do what your dealer is asking. They institute their own (sometimes ridiculous) policies/procedures for handling transfers from private citizens wherein they either outright refuse to do it, or they require copies of DLs, etc.

Best bet is to "politely" talk to this egghead and inform him that there is no requirement under federal or state law that he receive shipments from FFL holders or that he receive FFL paperwork with shipments, and then ask him (again..."politely") if it would be acceptable if the seller/shipper provided him with a copy of his driver's license or a concealed carry permit or other form of "state-issued" identification in lieu of the FFL copy so that he will have some form of identification/"CYA material" on the transfer?

Out of curiosity...if he won't go for any of this...ask him WTF his position is or how he plans to resolve the issue aside from just wrongfully sitting on your rifle for all eternity?!?!

Another thought to this whole freaking mess...

If after you try to reason with him, work out a compromise, show him the applicable federal law/regs from the ATF, etc. and he STILL won't handle the transfer, then you can decide if you want to get local law enforcement involved since he has essentially "stolen" personal property which you have bought/paid for since he is ignorant of applicable federal law. Also, there is always magistrate/small claims court. Since he has wrongfully "converted" your property and refuses, under applicable federal law, to proceed with a transfer...sue his @$$ and ask for either: a) a full refund from the dealer for the purchase price of the rifle (incl. shipping costs) he wrongfully refuses to transfer to you, plus court costs/filing fees/interest/etc.; or b) for an order asking for "specific performance" of his role as a dealer who agreed to handle an FFL transfer for you but who now wrongfully refuses to fulfill his obligations to you as the transferring dealer. The court can mandate the dealer to complete the transfer in accordance with application federal/state law (i.e. - you fill out a 4473, he calls it in, the sale/transfer gets approved, you leave with YOUR property). Again, you can also ask for your court costs, filing fees, etc.

Most small claims courts have a $5k max on damages, so assuming your rifle is valued at less than that...it should be fine to go through small claims.

The FFLs I've spoken to here (in KY) like to have a copy of the transferor's Driver's License, and there are some who will only accept a transfer from another FFL. They have always informed me what their transfer fee was along with what their requirements are before agreeing to receive anything for me. If he's refusing to accept your previously agreed upon payment for the transfer and (sounds like) he has no legal backing to do so, let him know you'll see him in court. You'll get your rifle pretty quickly or he'll be in for some trouble. I hope you get your gun quickly.

I sold a gun to a fellow in another state and the accepting dealer refused to let him have it. I caled the ATF office in his home town and told the agent the story. He said that i should send a copy of my DL to him and also hae a talk with him. sent copy then called him. I told him what the ATF agent said and that if he didnt release a report of a stolden gun would be in the making. He then changed his tune and the transfer went thru.MM

Well my FFL guy released my rifle to me today. He was nice enough, on his own will, to contact the seller and have him fax him a copy of his OL. And he also talked to the ATF office and explained to them the situation, and get this. FFL dealer said "the ATF rep I spoke to said that this transaction was not done right and an individual is prohibited by law from just walking in UPS and shipping a firearm. You can not sale a firearm across state lines to an individual and not ship it from FFL TO FFL." I said " wow everything you just told is completely the opposite of what the ATF website says. I think you might want to contact the person you talked to with from the ATF and tell them that eveything on their web site is backwards." FFL dealer says " well ATF said this was an illegal transaction but they will let it slide this time."

He was nice about the whole thing and I give him a little extra green for his troubles but honestly who has ever heard of the ATF letting an illegal transaction "slide"?

With all of your guys help when I went in there today I was confident that I was going to leave with my firearm. So a big thanks to you all.

First off...I am glad you got this situation fixed without having to resort to any "extreme" measures to get your rifle!

That said...I wouldn't piss on that dealer again if he was on FIRE!! He clearly has NO idea what the hell he is doing and I'd be f'in amazed if he actually talked to ANYBODY at ATF because what he says he was told by an ATF rep is just plain WRONG on many levels. Furthermore, as you observed, federal agencies aren't generally in the habit of telling licensed federal firearms dealers to violate federal law (not that anything that was done in this situation WAS a violation, but nevertheless).

Lesson learned...find a new dealer for future transactions and advise others you know in your area of the same!

I am listed on an FFL with the holder. I can guarantee you the FFL fed you a line of horseshit!

As long as the seller is legal, along with the buyer, a private individual can ship an FFL a firearm for transfer out of state. I always send a copy of my OL for an out of state transfer, along with a letter with the buyers name. I also send my cell number and email for contact should there be any questions.

If you are a FFL find ONE agent to deal with. It's been my experience, professionally and when I had a 01 FFL that if you ask a simple question to 20 agents in a room you will get 20 different answers.

I guess you are probably right maybe I was a little to easy going about the whole thing but I just took it as a lesson and now I know not to use that guy again. He was not going to charge me anything, I think that was guilt because he knew he screwed up. So I give him a few bucks and counted it as a cheap lesson.

I do transfers where I work on a daily basis, we either need an FFL, or a copy of a drivers license or state issued ID, so we can provide acquisition info in our books. Otherwise when ATF does an audit, we will get tagged for incomplete A&D info.

I receive long arms from private parties as a part of business. The only thing I need is a DL or state ID to put into my log book, if I get an FFL all the better, but not legally necessary for long arms.

The FFL dealer you dealt with is full of shit, I wouldn't give him the time of day, and I certainly wouldn't have given him extra funds for the line of shit he gave you.

My Boss/Attorney and I went over this out of curiosity, and either the dealer is completely full of sh!t and trying to make himself look like the good guy, or whoever he spoke to at the ATF was a mail clerk or other position of zero authority. A private party can in fact transfer a long arm to an FFL even over State lines.

Some FFLs are jealous jerks who don't like anything going out over their counter unless it was from their stock, unreasonable transfer charges or not. I've seen them try to charge and pocket state sales tax on the value of received interstate goods. Frankly, for the good of the OP's neighbors, I'd just as soon see him expose the FFL.

I agree, but the OP is a push-over so I would bet the FFL in question is in no danger of being outed. Giving the FFL extra money after knowingly being fucked by him was just kissing ass...

I think I'll call the ATF tomorrow and ask under what circumstances that they'll let illegal stuff slide. Maybe I'll catch them on a good day and someone will give me the verbal ok to build my own full auto.....fingers crossed!!

Some FFLs are jealous jerks who don't like anything going out over their counter unless it was from their stock, unreasonable transfer charges or not. Send your rifle out to get repaired, pay tax on it when you get it back.

Not that it matters anymore, but I think *technically* the dealer could have shipped the gun back to the original shipper/owner. Guns are shipped to FFL's in order to initiate a legal transfer. Since the gun was still 'transferred/belonged to' the original shipper, it could go back to him, w/o having it transferred back to him. Legally, I suppose it may be tricky, due to the fact that money had already changed hands.

For example, I shipped my LCP back to Ruger to have it worked on (recall) and they shipped it back to me, directly to my home. I was already the legal owner of it and it had already been transferred into my name from the initial sale. No future transfer was needed after the fact.

EDIT - Or would that gun have been transferred to the FFL once he received it?

Sounds to me like your FFL knew he fubar'd this one up and was trying to cover his ass. I've shipped guns privately to out of stats FFL's in the past without any issues. It was my understanding that non-FFL holders just couldnt ship USPS. But you most certainly can go to FedEx or UPS and ship it. You just have to send it overnight.

Non FFL's can ship long guns USPS
Non FFL's cannot ship hanguns USPS but FFL's can as long as it is to another FFL.
UPS and FedEx do not require overnight on long guns, but they do on handguns. Go to a hub not the UPS stores as they will not handle firearms period.

I think it is awsome that all these individuals "non ffls" know the law so much better than this guy did. Maybe he should read up on his ATF/FFL handbook. If you ever want to know what the ATF says about shipping, do a google search gunbroker shipping guide. It really breaks the ATF rules down.
