I have three specific questions about Florida gun law.

1. I read that there is no CCW permit anymore, that it's a right to carry state. Is this true? I know that certain counties/municipalities may require a permit.

2. I'm getting conflicting info on private gun sales. One source state you needed a permit to purchase a gun and another source stated that face to face private sales were permitted with some caveats, specifically that you're not selling to a known person who may not own a gun.

3. That after the Parkland shooting, they raised the age of purchase to 21 for all guns, pistols and long guns?

Permit not needed to carry concealed.
You can still get a permit and buy your shit with same day take home.


Here's the correction part:
Open carry is allowed if: you are hunting or fishing, or on your way to/from said activities.

Hillsborough county has a bullshit 3-day waiting period.
No wait if you have a concealed permit.


I do think the state should mandate that countries and townships follow state rules.

No licence or permit required to conceal carry, as stated above open carry with the hunting, fishing caveat.

3 day wait on long guns and handguns, exceptions on long guns are concealed permit, valid hunting licence with hunters safety course, or Law enforcement. Handgun the only exception to the 3 day wait is concealed carry permit or trading in a handgun.

Must be 21 to purchase a firearm, unless you are active duty military or Law Enforcement, everyone we have submitted has come back as delayed and has taken at least 10 days to clear.

21 is the min age for a retail purchase from a ffl.
A citizen can still sell to a citizen at 18.

Note also the permit is a weapons permit so there is some considerations (to me by interpretation) around a concealed knife, between that and reciprocity being "just add Utah" it pays dividends to get one in my opinion

Yes, it is concealed weapon, which with regards to a knife pertains to the normal restrictions of less than 3-1/2” blade. A pocket knife does not qualify as a weapon, unless of course you are entering an airport checkpoint, courthouse checkpoint, etc., etc.

Weapons also include other restricted items such as saps and similar items.

It’s best to just read the statute as @oneshot86 said above.

Didn't they also change the law after the Parkland Shooting so that if the police come to your house 56 times for domestic violence, assaults and threats towards family members and neighbors, they would arrest you instead of doing absolutely nothing?

Just remember though for you Floridians with no actual permit--once you cross the state line--you have nothing. Don't be a cheap ass, get the permit so there's no 3 day wait and you can carry in states that honor Florida's CHP.

Florida Statutes section 790.33(1) provides in full:

Except as expressly provided by the State Constitution or general law, the Legislature hereby declares that it is occupying the whole field of regulation of firearms and ammunition, including the purchase, sale, transfer, taxation, manufacture, ownership, possession, storage, and transportation thereof, to the exclusion of all existing and future county, city, town, or municipal ordinances or any administrative regulations or rules adopted by local or state government relating thereto. Any such existing ordinances, rules, or regulations are hereby declared null and void.


Hillsborough has the same 3 day wait as everywhere in the state (can be up to 5 days by local ordinance).

I’ve been here 43 years, always had the waiting period that I know of. If you were active mil, there is/was no waiting period.

Since I joined at 17 and all the guns I bought there was while I was still active duty, I guess I never realized it. I thought it was a Parkland whiplash bill like their red flag bullshit they passed a few years back. I left there 18 years ago and haven’t been back since, and you couldn’t beat me bad enough to get me to move back.

I know I’m not alone in this thought, but I absolutely fucking hate waiting periods.

I don’t disagree with you and also dislike waiting periods intensely. That’s why most legally minded folks bother to get their CWP. It’s not hard to do and if your prints are already in the system it matters little to that end.

everything guys have said is consistent with my experience. there is some variation county to county but not any loosening. don't know flagler. gun show rules also vary a fair bit. i think orange,hillsbourgh,pinellas you have to go FFL,buy or sell,no private sales FTF at a show. getting a DL/CCP look both ways is best. am sure that applies all states.

you do not need a permit for a private sale per the state. should want DL/CCP. in some counties you need FFL at a show. not a state law. that was a response to the orlando club shooting,which would have not been affected either way. check the laws in whatever co you are in. just don't take some guy's word for it.

Why "should" someone want a CCP? Does the person need to prove his innocence to you? That is not what the law says. Learn the law, live free, and stop making up extra stuff when there isn't any.

I'm actually quite surprised to learn that Florida has a waiting period. There is no waiting in Tennessee and I just assumed most Southern states were similar. That was kind of the whole point of the Brady Bill "Instant Background Check".

i think it is state wide. every FFL buy i have done last 5-10 (?) years has been 3 day or show CCP. i think some counties it is 3 day always. doesn't matter with private but the vast majority of people here insist on DL and CCP. haven't met anyone in years that doesn't have 1.
