So the 3rd-degree charge is dropped, but the 2nd-degree charge remains. If I understand this correctly, it places an additional burden of proof on the prosecutors. Should be fun to see how this plays out.
 
5 OD's. None died. Brought back 2 of them myself, personally... The 3 that I couldnt, had alcohol/benzos to go along with it.

May not be hundreds of thousands, but Ive literally watched the process in detail multiple times. Only once unconscious did the danger come.

My point is this: how many people have ever died from drug induced respiratory depression WHILE CONSCIOUS? How many folks have you seen that needed a ventilator due to drug induced respiratory depression WHILE CONSCIOUS? With no lung damage otherwise, or other physical impediment?
Its just a very hard path for me to believe. Opioid overdoses aint opioid overdoses if the person never goes unconscious. They would just be holding their breath. Unconsciousness is a necessary component. Followed by a more labored/shallower and shallower breathing, with more and more time between breaths.

This dude was squirming and wrestling until they put him out on the ground, and then pleading with the officer that he couldnt breathe.. almost as if his chest muscles were getting more and more tired from inhaling with all the weight on him?

Opioids dont make you delusional, or physically block you from inhaling air. If you're awake, you will breathe

Seriously, from a retired LEO point of view this whole incident went down exactly like it does with most career criminals. Lies, obfuscation and somewhat passive resistance. It's really hard when your partner or a senior officer does something stupid or wrong right in front of you. In the the moment, it might not seem that big a deal and junior officers (especialy new guys) are best seen not heard. I'm not saying it's right, but that's the way it is. Don't come at me with the "well if was me I would have..." that's all bullshit till you're there. Every use of force is different and it's an opportunity to turn in to a shit show every friggen time. It's pretty common folks don't speak up and when you're being yelled at and filmed, judgement and time distortion become a very real problem. Sucks dude is dead, and it sucks these cops careers and lives as they know it are over. Honestly that's part of why I jumped when I did. Bad guys do stuff that you have to respond to. Nothing goes the way you planned and you don't always know how your partners (or you to be fair) will respond.
