Different state, but I'm thinking about the truck driver just had mandatory sentences of 110 years for 27 guilty counts including 4 vehicular homicides (not vehicular manslaughter, like DUIs) last week. (For those who didn't here of this, 23 yo Cuban on green card had out of control truck on I70 in Lakewood CO, he didn't use emergency truck ramp or second place he could have pulled over, caused a crash with 4 dead, 6 seriously injured, and 28 vehicles damaged/destroyed.) Other factors: No influence of drugs or alcohol, cooperated with authorities, poor language skills at time (? able to read warning/ramp signs - failure of licensing?), unfamiliar with area (out of Houston, unfamiliar with area/Interstate (failure of employer?). There is petition signed by 4.2million to revise his sentence/request clemency, as well as a potential boycott of all licensed trucking through Colorado, even DA thinks there is a problem.
Manslaughter vs. homicide, nature of negligence, needs some legal attention.

I don't know what she should've been convicted of, be some sort of negligent homicide or whatever is below manslaughter. She did accidentally kill someone, and there should be consequences, but I'm not sure decades in prison is just.

In my admittedly layman opinion, there should be an effort to make sure that the muscle memory you build for drawing and firing your service weapon is not the same as that of using your taser. I've seen a lot of cops that wear theirs cross draw, just forward of their hip, not sure how hers was carried, but if it was on the same side as her pistol, that seems to be a problem to me.

The way the prosecution argued their case was by bringing up lots of unrelated facts, cumulative evidence that didn't relate to the charges over and over again, outright lying at times both from a state witness and prosecutors themselves. It was a perversion of a trial by the state. Incredibly stupid arguments were made reminiscent of Binger vs Rittenhouse.: "What was so urgent about a fire that you had to put it out?"
The state spent days arguing that potter was not justified in trying to use a taser. Reasons like: She was too close to the target, the target was sitting in a car and could have sped off (he was trying to do that anyway), she should have tasered him in the back (what?), both officers had everything under control until she yelled taser, taser, taser, despite both officers testifying they were struggling. The state's expert witness said the cops shouldn't have tried to continue arresting Duante. They could go find him later.
The prosecutors were out for blood, not justice according to the actions of Potter related to laws on the books at the time of trial. You don't have to take my word for it either, go watch the trial videos

I wont speak to "making up new laws that dont exist"... because manslaughter I think is a pretty well established law.
But the rest, I also quote deersniper, because thats the truth of what prosecutors do. The jury trial I was on the prosecutor had a bunch of people on the stand that had nothing to do with the case and a few of his witnesses didnt help him.
Its up to the jury to parse out the fact from the fiction or the reaching or what have you. MOST jury's are smart enough(or have enough smart people on them) that can sniff out the bull shit. The jury I sat on wasnt made up of a bunch of ivy league valedictorians thats for sure and we waded through the bull shit. And our trial was peanuts compared to this one.
Again, once you go into deliberations and have jury instructions, you work through them and the language of the law which, up to this point, you probably didnt have access to.
I will agree that prosecutors can be reaching at times, but thats what they do.
I wont agree that the rule of law is a joke, but its far more nuanced and involved than a lot of people think.
Most people under manslaughter as something like "accidental killing", yet the legal definition could have like 5 or 6 parts... Maybe she's not guilty of 4 of them, but they found enough to see she was guilty on 1 or 2 parts... thus they have to find her guilty on the whole charge.
When will they remove tasers that replicate handguns seems like a asshole theory to have the non lethal device shaped exactly like the lethal weapon. Should have a straight round handle that is totally opposite and feel of a handgun, make it like a flashlight.
I'll try to elaborate on the new laws thing I mentioned.
The jury instructions state they need to find Potter was conscious of what she was doing. From all the evidence brought in, she thought she had a taser in her hand, not a gun. I don't recall prosecutors spending time arguing Potter was aware a glock was in her hand. In their closing they even argued she made a mistake. They inundated the jury with other info to appear as if the case was about something else. That's why the state spent so long trying to shut down a taser being appropriate at all in the situation.
The conviction doesn't match what was presented as the charge. For it to match, the jury would have found she lied about mistaking her gun for a taser, but then manslaughter doesn't seem appropriate as that would be premeditated killing with an attempt to hide it as a mistake. There is a contradiction with how the instruction is written and what the jury decided based on the evidence because the prosecution lied to them on what it meant, effectively making a new law.

Several lawyers following the trial told USA TODAY the case hinges on how jurors understand whether Potter acted "consciously." The charges do not require prosecutors to prove that Potter, who is white, intended to kill the 20-year-old Black motorist.
"It boils down to — how does the jury apply that consciousness element in both of these charges," said Rachel Moran, an associate law professor at the University of St. Thomas in St. Paul, Minnesota. "There’s probably going to be disagreement among those 12 people about what it means in this particular case.
So in the jury instructions "conscious" should have been defined because IMO there are multiple definitions of plain language "conscious" so it should have been defined as to what the law intends. Jury instructions are agreed upon by both prosecution and defense and the judge, so if it was spelled out in the jury instructions it doesnt much matter what the prosecution attempted to define it as during the trial.
In the trial I was part of other jurors were trying to make shit up and I kept going back to the jury instructions and reading the legal definition. I finally got them to realize that what they thought something meant didnt mean jack nor shit since we had a legal definition we had to follow.
So, we are facing the highest rates of violent crimes ever, along with a significant decrease in the most experienced and qualified officers due to combination of vaccine mandates, hatred toward police, and fear of criminal prosecution (right or wrong)...there's going to be a lot more mistakes.

I agree. There's leeway due because society SENT her there. Yeah, she fucked up. But, he created the situation that led to his own death and put her in the situation where she could fuck up and kill him by accident.
There's no legal precedent for this, and it's just my opinion. IMO this is part of the social contract with law enforcement: I agree to risk my health, safety, even my life to deal with shit other people aren't willing to... in return I expect some leeway when shit goes sideways, ESPECIALLY if it goes sideways because of something the criminal, that you sent me to deal with, does when I get there.
