Apparently there’s some controversy over this feat, for three reasons. There are at least two stuntmen at the time that claim they did it and not Tom Mix, the gap is only 20’ wide and therefore the photo had obviously been faked as the scale of the horse and rider are way off, and some amount of skepticism from those of that era that it ever happened at all.

Only in Texas (that I'm aware of). It was night time (and, therefore, deadly force was authorized for a property crime). If this were FL, I believe the shooter would be charged with: 1) Use of deadly force in defense of property; 2) Manslaughter (she shot as the perp was fleeing... there was no apparent "threat of imminent death or great bodily harm").
