My dealer required 1 copy of the trust, 1 copy of the schedule A, 1 copy of the certificate of notary with raised seal stamp, and they filled out and included 2 form 4's.
They specifically asked that it was a copy of the trust. I don't think they send it back.

Re: NFA Trust and Form 4

You only have to submit one copy of your trust. DO NOT SEND IN THE ORIGINAL - you will not get it back.

If you submit multiple Form 4 packets together (say you purchased 3 suppressors at the same time) you still only need to send in one copy of your trust with the packet.

Re: NFA Trust and Form 4

Major,

From your experience, does the ATF require Schedule A, B, and C's to be sent in along with your Declaration of Trust and Notary Document?

Thanks!

Re: NFA Trust and Form 4

You need to send in Schedule A-- the complete trust. In the trust it referes to Schedule A for your assests. If you do not send that in, it may get bounced. I also ammended my trust to include the suppressor specifically stating the serial number.

At least tha is what I did and that is what my dealer instructed me to do.

Good luck to both of us .. mine has been in for about 30 days. No word yet.

The bottom line is that you need to send in every single page of your trust - if you leave anything out, it may get bounced. I'm only familiar with Schedule "A"s, but if your Declaration of Trust references Schedules "B" and/or "C" then you should send them in as well.

If you send in multiple items at once, all in the same envelope they will except one trust per submission. I was asked to do it this way as they want to reduce paper coming in. If your sending in 3-5 items at once, thats one heavy envelope.

Re: NFA Trust and Form 4

Glad we are all streight now.... Can the BATF make it any more convaluted or difficult .... lol

just send in your trigger finger with all submissions....

I had my SBR'd lower receiver serial # on the schedule A and was asked to send in a copy of the schedule A without it in there. A friend of mine has logged the item in everytime before approval and never heard a peep about it being logged into the trust before. ATF seems a little inconsistent in their guidance for this. I believe my examiner was snook.

Lol ... Goverments are always consistant right .... consistantly inconsistant....

Re: NFA Trust and Form 4

So what happens if I decide to get multiple suppressors at different times (e.g. one this year, one two years down the road, etc.)? Can I assign later purchases to the same Trust? Logic says yes, but I'm waiting to hear what the government's answer is....

Re: NFA Trust and Form 4

does "schedule A" get amended with a new sheet every time an item is added or is it a seperate sheet, should it have a date on acquistion of new stuff ? Does ATF need to have most up to date "A" ?

EX:
I have my "A" blank prior to it going to ATF for my first can, then before 1st can was approved I sent off 2 more form4's. First can came back June 4th and added. So ATF has my trust with no items on "A" ... is this a problem ?

This is true.

Re: NFA Trust and Form 4

If its your first can then "A" is sent in blank...correct

but what if you had one can comeback approved while 2 other form4's are pending. Do I need to send in a revised "A" with can that was approved ?

Re: NFA Trust and Form 4

I have always sent my Schedule A in with the item in question on the trust. It shows that you intend to put the item where it belongs. I have never had a problem with the approval process.

Re: NFA Trust and Form 4

I have drawn up a trust and was wondering what parts need to be notarized? The declaration of Trust, the Memorandum of Trust or both? The schedule A does not need to be notarized correct? Thanks for the help

Re: NFA Trust and Form 4

I have several items on schedule A. Always send 2 Form 4's, copy of trust, updated schedule A and $200. First time had the first item on it including manufacturer, serial number and description. Each time I added an item, I sent copy of trust and new schedule A. New schedule A always includes the item being added. You bought the item and the trust owns it so it needs to be on the list, even though you can't take possession of it until it's approved. The only thing I ever change is the updated schedule A. Never had an issue.
