I have a question about registering a short barrel rifle. I have three suppressors that I have bought over the last few years. They are registered to me not a trust. So I have done three form 4 and know I have to pay the tax and such.

I’m looking at buying a sbr upper. I read something a while back that you had to register the lower to the upper. What exactly does that mean? Do I have to have the serial number for the lower add to the upper? Thanks for the help.

On the Form 1 (to manufacture) for the SBR it will ask you what caliber and barrel length, this will be the main configuration. The lower will be registered to use that barrel length/caliber. If you decide to buy another upper(s), you can do so as long as you retain the original configuration since the changes are not permanent.

The only markings you will need is your name, city, and state on the lower since you are the manufacturer.

You can't "manufacture" a lower as a machine gun, but if you droped the $10k plus to buy a registered machine gun lower, you can swap short uppers on it at will.

I have a KAC SR 15 and was going to buy the SBR upper and switch the uppers out to play. So do I need to add name, city, and state on the lower?

Yes. There are depth requirements so check the ATF website.

if its a current production lower you can just use the serial# already placed there

you have to engrave when you are "building" the entire lower as these come blank i think

this is directly quoted from 5320.1 (Form 1) part 4 section G

Your info goes in 4h, "Additional Description". Since you are "manufacturing" the SBR, you will be the new maker. You can buy a factory registered SBR lower which will require no additional engravings and will hold it's resale value.

The manufacturer is Spikes Tactical, Rock River, Knights Armament, but he is not the manufacturer of the lower. He is the maker of the short barrel "lower" to have it registered as such.

he already has a registered firearm that Knights Armament manufactured... he is just converting and registering as a SBR

Maybe I'm reading everyone else's answers differently but I think you are asking about engraving the serial number of the lower on the upper?

If this is what you are asking, then no, you do not engrave anything on the upper receiver. The lower is the weapon in the eyes of the ATF, so when you "manufacture" a SBR, you are engraving your info on the lower in addition to what the original manufacturer (Colt, Rock River, LMT etc) already engraved - unless you are getting a factory SBR.

The only things the ATF cares about in relation to the upper receiver is the caliber, barrel length and overall length (of the entire weapon) and all these are noted on the Form 1.

The additional markings is what you engraved...which is name, city, and state. He has a registered firearm, but NOT a registered SBR.

Unless this SR-15 was purchased from Knight's as a factory SBR, you are wrong.

He will need to engrave his name (or the name of his trust) as well as the city and state he lives in on the lower. The serial number remains the same.

Yes. You will also need complete a Form 1 and pay $200, then wait to put the upper on the lower until the Form 1 is returned to you from the ATF.

Edit to add: After you do this once, you'll see it isn't that difficult but, I think you might be best served by talking face to face with a Class 3 dealer or NFA attorney in your area to make sure you are doing this correctly. No sense in making a 10 year / $250,000 mistake if it can easily be prevented with a little communication with professionals rather than internet advice.

yes i have read this letter.

I have a form 1 pending for a SBR, I filled it out to what is stated on the actual form and coping an approved form at my dealers shop. I guess if it comes back i'll gladly correct it, or engrave whatever I need
