SCOTUS Refuse to Hear Case on Bump Stock Ban

I saw that the drive-by media was crowing about today's refusal of the SCOTUS to hear the case of Guedes V. US. Nevertheless, this seems to be an even-handed article to get you up to speed on the story.

I've also attached the ruling from the SCOTUS. I could pick out the most salient statements in the ruling written by Gorsuch.

However, there's a lot he has to say about the bump stock ban. Read the ruling and you will see that the anti-gun media has not got a lot to crow about.

I don't drink anymore but am thinking about getting a bottle of bonded bourbon ready for the day that RBG assumes room temperature.

That's correct but here's some things to consider.

1) it takes four justices to grant a writ of certiorari.
2) We know that there are probably four justices on the court that would vote to overturn the ban.
3) Roberts (the backstabber) would be the swing vote. If he voted to uphold the ban, then it stays.
4) It's also a 2A case of great significance that would have ripple effects for years to come. We all know that.
5) Methinks that the four conservative justices decided not to vote for a writ of certiorari cause they know that with Roberts voting for the ban then the 2A would lose out.
6) So the four conservative justices are waiting for RBG to expire and for another pro-gun justice to be seated before voting to hear another 2A case.

Just my $.02 worth. Not saying that I am entirely correct but worth thinking about.

Exactly. The reason behind the disgraceful conduct is the leftist judges and the leftists presidents who put them there. And, yes, there have been some conservative presidents who have put the wrong judge in there as well.

Judge's are not supposed to let events cloud their independent thinking but they do.

I'm not from Virginia but when I talk to most people in my state they haven't got the foggiest idea of what is going on in that state regarding 2A sanctuary movement.

Let that sink in for a moment. The average John Q. Public hasn't taken much notice on 2A events, unless you count the drivel the MSM feeds him.

But you can bet a 1,000 rounds of 6.5 CM match ammunition that the politicians and the judges are watching those events.

The elitists that are watching are worried. Think pitchforks.

I would not be staking my overall plans on the outcome of a Bump Stock Ban lawsuit. Yes, it's just, but things are heating up in Virginia that would put this little smolder out in a small, nearly dry puddle. Virginia is a smoldering dumpster fire.

This is a distraction, one of the many divisions by which one might be conquered.

Concentrate on the bigger fights.

If Virginia goes down, we'll all be looking at the same game plan. That's where the real battle is.

Let's explore that thought again. It could be that the four conservative Justices; Alito, Gorsuch, Kavanaugh and Thomas would really like to overturn the ban but are worried about Roberts stabbing conservatives in the back again.

Maybe they, like the rest of us, are waiting for RBG to expire. Then, and if, they get a conservative pro-gun member on the court, they would vote to hear the case.

Now let's flip that thought around for a second. If the four leftist Justices, Beyer, Ginsburg, Kagan and Sotomayor thought they had a good chance of upholding the ban they would have voted for a writ of certiorari. They might worry about Roberts siding with the conservative wing of the court.

Like the rest of the leftists in this country, they are hoping that RBG stays alive long enough and IF Trump is defeated this fall, they get another leftist judge on the bench. However, that still would not quell their fears of Roberts siding with the conservative wing.

Those leftist Justices know, in their own minds, that the bump stock ban is wrong. If the arguments before them are too compelling, then Roberts could side with the conservatives.

In the meantime, the leftist Justices have one the first round because the bump stock ban is in place.

IMHO, Gorsuch just let the rest of us know that there are at least four justices willing to hear the case and possible overturn the ban but that they would be outnumbered by a backstabbing Roberts.

We won a temporary victory concerning banning "assault rifles," suppressors, "high capacity" mags and maybe something else I'm forgetting. It was referred for study and will be back up next year. You can bet the dems will be back with a vengeance. A bunch of really bad bills have/will pass. Most were changed a little but all of them are still very bad. I can tell you at this point there are a lot of pissed off Virginians. Whether that ultimately changes anything, time will tell. It is not just guns, the dems are on steroids changing everything that has made this state a good place to live.

There is nothing special about Virginia except it creates another jurisdiction to potentially launch civil rights litigation.

That might be useful if the state of Virginia will not put up as vigorous a defense as NY, California or anywhere else with bad laws. It could be good if the appeals court circuit creates good splits too.

If Trump is re-ellected and RGB goes tits up, very good things could start happening in the next 5-10 years.

Virginia is not going to kick off some sort of revolution.

Nobody in Gov or scotus is plotting or planning for any other justice to die and somehow save our 2nd.
