Va Gun Confiscation Looming!

Unfortunately, VA is now lost. I don’t see voting retaking any ground. I mean sure you might get your guy in place but the chances of these bills being done away with in the future is very slim and even if they are that means you guys are basically living in a monarchy the next couple years. And you would be felons not complying with the new laws. Am I right? If all this crap passes y’all know what to do. I just don’t see anyone doing it. And it’s not just in VA either. Sad, when the Iranians are braver than the Americans when they don’t even have the rights we do.

We need to quit engaging in conversations where we refer to these extra- and un-Constitutional dealings as "Laws."

They are not "LAWS" if they are patently unconstitutional, and especially if the SCOTUS already and even recently ruled such "Laws" are null and void.

We should recognize and obey actual, real, this-will-survive-Constitutional-scrutiny, laws. Our oath requires this.

We do not recognize, and we oppose ANY usurpation of the Constitution. Our oath requires this as well.

NOTHING in my oath binds me to obedience of unconstitutional or extra-Constitutional acts.

NOTHING in my oath requires me to obey an illegal order, in fact I am bound to oppose it.

SCOTUS spoke to these issues in District of Columbia v. Heller, McDonald v. City of Chicago and in Marbury v. Madison

"The court then held that the Second Amendment "protects an individual right to keep and bear arms", that the "right existed prior to the formation of the new government under the Constitution", also stating that the right was "premised on the private use of arms for activities such as hunting and self-defense, the latter being understood as resistance to either private lawlessness or the depredations of a tyrannical government (or a threat from abroad)." They also noted that though the right to bear arms also helped preserve the citizen militia, "the activities [the Amendment] protects are not limited to militia service, nor is an individual's enjoyment of the right contingent upon his or her continued or intermittent enrollment in the militia." - District of Columbia v. Heller, 554 U.S. 570 (2008

"(SCOTUS) reversed the Seventh Circuit's decision, holding that the Second Amendment was incorporated under the Fourteenth Amendment thus protecting those rights from infringement by state and local governments." - McDonald v. Chicago, 561 U.S. 742 (2010)

"Thus, the particular phraseology of the Constitution of the United States confirms and strengthens the principle, supposed to be essential to all written Constitutions, that a law repugnant to the Constitution is void." — Marbury, 5 U.S. at 180.

Relying on the SCOTUS, Constitution, 2A and the BoR's is hoping for rainbows. They didn't write it for criminals to adhere to. They wrote it to warn us. Wad all that shit up & throw it in the trash if nobodys gonna follow it. We dont need papers to justify rights. Or the supreme court. Court deez nuts.

I talked yesterday to the guy who financed and co-counseled the District of Columbia v. Heller case in front of the SCOTUS. He assured me that the legal eagles who would argue such cases at the highest level are keeping a keen eye on things including the red-flag laws that could be un-constitutional on many levels.

However, he also made clear what should be obvious to everyone: In order for this to go to any court, let alone the SCOTUS, there needs to be a victim of these 'laws' that can sue the state of VA. (It took a while to find a plaintiff like Heller who could credibly claim material harm from the laws in DC - as explained in the linked Wikipedia article.)

As much as I hate to say this, Virginians will have to bend over for a while until their pain is enough to get a court to hear their case. The lower courts will most likely side with the state and a lot of time and money will be needed to take this up the legal food chain. In the meantime, things will get worse from the legislative side. What we see right now is just the opening act.

That's what you get for being too busy to vote while the Left literally raises the dead for their agenda. We get the government we deserve through our (in)actions.

So, kill 'em all and let God sort them out, right? Time to ignite the Boo-ga-Loo and anyone who doesn't is a total pussy. We have had enough (not your State) and ya'll need to grow a nut and start shooting. Right?

I'm appalled at the Chest Thumpers who *DON'T* live in Virginia (or Illinois or any of the other 2A Sanctuary States) who figure it's all just bullshit and we all ought to just grab up our guns and start a Revolution. But *they* are gonna sit and watch it on TV.

Fuck me. Sick and tired of Chest Thumpers with great ideas how I/we are supposed to get ourselves killed at their demand. It ain't time for violence yet. You want it?

*YOU* start it. Otherwise shut the Fuck Up.

Please and Thank You. This is all just starting and there are still shit loads of options beyond going all BoogaLoo. Fuck you Chest Thumping Mother Fuckers.

There is a thread here in the pit about the uprisings in Iran. Most people take the stance that we should stay out of it until the people there have proven that their future is worth something to them, that they are serious about fighting for their rights. (Please keep in mind that the folks being shot at on the streets of Tehran right now do not have millions of modern guns at their disposal.)

I guess it would not be wrong to apply the same principle domestically. Why should I fix your shithole, if you are content living in it?

Seriously, I have spent quite a few hours thinking about how to take puppet masters like Bloomturd out of the fight, how to turn the gullible supporters of the tyrants against their handlers, etc. I have found plenty of practical avenues. What I cannot find is a reason to put darkness in my soul and potentially blood on my hands for people who just want to be comfortable. Those who trade safety (and worry about "how I/we are supposed to get ourselves killed") for liberty do not deserve either and will lose both.

Even if I would be diagnosed with stage 4 cancer tomorrow and had nothing personally to lose, I doubt that this would motivate me to go to extremes for people who are not willing to raise a barrel or a pitchfork for their own cause.

I will act when this stuff affects me personally. Visiting Auschwitz, I learned two things: A) Genocide sucks and B) If you wait until they walk you to the 'showers' with your dick dangling between your naked legs, you have waited far too long to show your teeth.

The issues in front of us go way beyond gun-rights. We are in the second -still cold- civil war over fundamental philosophies of life and governance. Slavery is again the big issue. This time it is about Socialism (slavery to the collective) vs Liberty of the Individual. I have lost most hope that this can be resolved with negotiations and compromises. The only thing that will stop a committed Socialist is lack of oxygen to the brain. History is very clear about that. These are the people we have to deal with sooner or later.

Your right, because everything up until this point has been working so well.

Who is silent? Certainly not Virginians.

We are the state that in 2 months rallied 10s of thousands of people at local board meetings and turned a state into a 96% 2A sanctuary.

1000s have already attended the first few days of our state congressional session.

We have a highly organized and professional organization spearheading our efforts that is raising huge sums of money for the fight (VCDL) in no small part to the generosity of fellow patriots throughout the US.

We will peacefully lobby next week with 10s of thousands of our compatriots.

VA is facing one of the fastest and most concerted efforts by the gun grabbers in the history of “gun controls” to flip a state. Which also happens to be the state arguably most responsible for the foundation of the nation and the protection of our inalienable rights. A fact for which I’m sure makes VA all the more enticing to them.

For those who think this is Virginia’s problem you are most assuredly wrong. Everytown was lobbying at the WV state house today. WV currently ranks as the 4th most conservative state in the country. The tactics used in VA will definitely be used in your state in time.

The democrats in VA have little regard for the constitution or democratic process. Simply look at the methods being used to pass legislation currently.

We however for now must adhere to these principles as they are the foundation upon which we stand.

BS. Virginia elected the current officials damn well knowing their stance on certain issues. From "gun control" to abortion.

What you are seeing is the consequences of an election.

Want to argue the legality of proposed laws etc, thats a different matter. Want to argue about securing elections via voter ID...another matter as well.

I’m going to have to get on to the guy that wrote this. It’s my understanding that the story below is false as all they did was get rid of one bill and roll it into another, correct? Can someone from VA following this closely confirm that this was just rolled into another bill? Pls spread the word that this isn’t dead but was just rolled into another bill!

While true they were elected the districts were redrawn by order of the 4th circuit court (the most liberal in the US). Furthermore the sheer amount of money spent by the likes of Bloomberg, Soros etc. significantly influences the election.

My comment was more specifically directed at the legislatures adherence to its own rules regarding committees, passing of legislation, and stifling the voice of the people. I also find it hard to argue that the democrats in VA are supporting the constitution.

You are correct, SB16 was withdrawn in favor of HB961. Essentially the same bill although adding grandfathering with registration through application of a permit and $50 fee per firearm.

SB 16 was taken off the table yesterday
HB 961 is still alive and well

The difference is HB 961 allows you to own your assault weapon for one extra year provided that you register it (and I think pay a permit fee)

So, nothing has been gained

You are right, but here is my problem. I think someone should be able to contest this on a legal basis you list above, the simple fact that this is a God given right, declared in the BOR is reason enough for me to argue this in court. Everyone that has to abide by these laws is a victim and the fact that we have to go to court and spend hard earned money on a bunch of bullshit that is spelled out pretty clearly is victim enough in and of itself.

You see they have bastardized the system so much that they are using it to their advantage and nobody really knows the legal process anymore. This shit needs to end or it’s going to be too late as it’s clear the populace is already becoming too brainwashed to stand for themselves. This won’t ever end until they get what they want. Nobody is a fool enough to go storm the capital on their own. You have to have numbers. If everyone of these people showed up armed it would send a clear message, fear is a powerful thing and I know it works because I know of a certain congressman that retired after a letter reached his desk.

You guys keep saying try all channels, well I would say that we’ve been trying all channels and it’s clearly not working. This doesn’t need to go to the USSC again because they have already ruled on it, multiple times!!!! We should not be expending so much energy and money beating a dead horse. It’s been ruled on, either the rulings stand or they don’t mean shit. You can’t just keep kicking the shit up there because you don’t like the ruling. Talk about losing faith in the system.

Maybe we haven’t got to the point of the Iranians yet because it seems clear to me that most of the US is not willing to fight for individual liberty, sadly. If they did, we wouldn’t be in this predicament or would they? Lots of people still don’t even know about this.

There are people from all kinds of states that would come and stand up to this BS, all they need is someone to lead them. Believe me, if I had the first clue as to how then I’d be on it. I guarantee you if some of these gun reviewers with millions of followers would put the message out it could be pulled off with ease. That’s what amazes me. The ones with the most pull seem to be the ones sitting on their asses. That includes manufacturers.

It's worse than that. SB16 grandfathered standard capacity mags and didn't ban suppressors (though it would've prohibited their use on semi-auto centerfires).

The house bill may have a registration scheme for the firearms it proposes to ban, but it also includes a straight ban on possession of all silencers, all mags over 10 rounds, and all mags with removable floor plates than can accept an extension to increase their capacity above 10 rounds (so 10rd pmags, g43 mags, most 1911 mags, etc. would all be banned).

And it keeps the ban on "any part of combination of parts than can be used to assemble an assault weapon," which could be just about anything.

HB 961 is the single worst bill of it's kind I've ever seen. The text is here (the text in italics is the proposed changes to existing law) :

Sounds like that monstrous abortion of lawmaking will ban AICS pattern mags as well.

Sounds like that monstrous abortion of lawmaking will ban AICS pattern mags as well.

It would, as it doesn't specify the mags be for use in a semi-auto, or even a centerfire. It would even ban something like a CZ455 10 round mag. Here's the magazine ban portion of the bill:

§ 18.2-308.9. Import, sale, possession, etc., of certain firearms magazines; penalty.
A. For purposes of this section, "large-capacity firearm magazine" means any firearm magazine, belt, drum, feed strip, or similar device that has the capacity of, or can be readily restored or converted to accept, more than 10 rounds of ammunition, including any such device with a removable floor plate or end plate if the device can be readily extended to accept more than 10 rounds of ammunition. "Large-capacity firearm magazine" does not include (i) a magazine, belt, drum, feed strip, or similar device that has been permanently altered so that it cannot accept more than 10 rounds of ammunition or (ii) an attached tubular device designed to accept and only capable of operating with .22 caliber rimfire ammunition.
B. It is unlawful for any person to import, sell, transfer, manufacture, purchase, possess, or transport any large-capacity firearm magazine. A violation of this section is punishable as a Class 6 felony.
C. (Exemption for LEO & MIL (both for duty use only,) and dealers selling to LEO.)

Just learned about this (dont burn me too bad for linking arfcom...)

And here is the link to the website. Haven't had time to read it all yet, just got home from work.

Now we are talking. Let a second green wave of militia-forming sweep over VA. Let it be know that not only the Left means business.

I particularly like that this goes beyond guns to the core of the cultural and political conflict.

The only good news is that the Left has switched from slowly boiling the frog to unveiled despotic ambitions and actions on every front. I hope that will wake the swing voters up and get the conservatives of their asses in November. If not, we probably deserve the Gulags.

I'll add this interview with one of the great of the greatest generation as an inspiration. It's long but worth every minute IMO. With all the snowflakes running around these days, we should reflect more on the fortitude of the giants on whose shoulders we live our lives.

The VA113 thing is interesting and the logical next step to 2A sanctuaries. As has been discussed before mutual defense pacts amongst the counties to oppose the enforcement of unconstitutional laws will be necessary for sanctuary status to have any teeth. Perhaps we should be making a concerted effort using this resolution language to lobby our local county government to pass this and begin the organization of county militias. I agree any militia must be under the authority of the public power for legitimacy.

He is a coward through and through. Northam wants to take away our Constitutional right to bear arms and defend ourselves, but then wants to hide behind a wall of state troopers because he is afraid of the people he wants to rule over. Just another pissant, would-be-despot. At the end of the day he is an inconsequential puppet that will be discarded once he has served his purpose and Bloomberg pulls his arm out of his ass.
