I talked yesterday to the guy who financed and co-counseled the District of Columbia v. Heller case in front of the SCOTUS. He assured me that the legal eagles who would argue such cases at the highest level are keeping a keen eye on things including the red-flag laws that could be un-constitutional on many levels.We need to quit engaging in conversations where we refer to these extra- and un-Constitutional dealings as "Laws."
They are not "LAWS" if they are patently unconstitutional, and especially if the SCOTUS already and even recently ruled such "Laws" are null and void.
We should recognize and obey actual, real, this-will-survive-Constitutional-scrutiny, laws. Our oath requires this.
We do not recognize, and we oppose ANY usurpation of the Constitution. Our oath requires this as well.
NOTHING in my oath binds me to obedience of unconstitutional or extra-Constitutional acts.
NOTHING in my oath requires me to obey an illegal order, in fact I am bound to oppose it.
SCOTUS spoke to these issues in District of Columbia v. Heller, McDonald v. City of Chicago and in Marbury v. Madison
"The court then held that the Second Amendment "protects an individual right to keep and bear arms", that the "right existed prior to the formation of the new government under the Constitution", also stating that the right was "premised on the private use of arms for activities such as hunting and self-defense, the latter being understood as resistance to either private lawlessness or the depredations of a tyrannical government (or a threat from abroad)." They also noted that though the right to bear arms also helped preserve the citizen militia, "the activities [the Amendment] protects are not limited to militia service, nor is an individual's enjoyment of the right contingent upon his or her continued or intermittent enrollment in the militia." - District of Columbia v. Seriously, I have spent quite a few hours thinking about how to take puppet masters like Bloomturd out of the fight, how to turn the gullible supporters of the tyrants against their handlers, etc. I have found plenty of practical avenues. What I cannot find is a reason to put darkness in my soul and potentially blood on my hands for people who just want to be comfortable. Those who trade safety (and worry about "how I/we are supposed to get ourselves killed") for liberty do not deserve either and will lose both.
Even if I would be diagnosed with stage 4 cancer tomorrow and had nothing personally to lose, I doubt that this would motivate me to go to extremes for people who are not willing to raise a barrel or a pitchfork for their own cause.
I will act when this stuff affects me personally. Visiting Auschwitz, I learned two things: A) Genocide sucks and B) If you wait until they walk you to the 'showers' with your dick dangling between your naked legs, you have waited far too long to show your teeth.
The issues in front of us go way beyond gun-rights. We are in the second -still cold- civil war over fundamental philosophies of life and governance. Slavery is again the big issue. This time it is about Socialism (slavery to the collective) vs Liberty of the Individual. I have lost most hope that this can be resolved with negotiations and compromises. The only thing that will stop a committed Socialist is lack of oxygen to the brain. History is very clear about that. These are the people we have to deal with sooner or later.

Sounds like that monstrous abortion of lawmaking will ban AICS pattern mags as well.It's worse than that. SB16 grandfathered standard capacity mags and didn't ban suppressors (though it would've prohibited their use on semi-auto centerfires).
The house bill may have a registration scheme for the firearms it proposes to ban, but it also includes a straight ban on possession of all silencers, all mags over 10 rounds, and all mags with removable floor plates than can accept an extension to increase their capacity above 10 rounds (so 10rd pmags, g43 mags, most 1911 mags, etc. would all be banned).
And it keeps the ban on "any part of combination of parts than can be used to assemble an assault weapon," which could be just about anything.

The only good news is that the Left has switched from slowly boiling the frog to unveiled despotic ambitions and actions on every front. I think someone should be able to contest this on a legal basis you list above, the simple fact that this is a God given right, declared in the BOR is reason enough for me to argue this in court. Everyone that has to abide by these laws is a victim and the fact that we have to go to court and spend hard earned money on a bunch of bullshit that is spelled out pretty clearly is victim enough in and of itself.
You see they have bastardized the system so much that they are using it to their advantage and nobody really knows the legal process anymore.
