Window Tint Misdemeanor Arrest Question/Rant

So some of y'all don't know that I live on the outer banks which has a full time residence of about 30000 people. But in the summer we have a estimated population increase to about 500000. We also have enough full time police for 500000 people which is GREAT and kind of annoying depending on the individual. In 3 years have been pulled over 8 times. Only one time for speeding. I have been pulled a couple times for window tint, which I admit I'm in the wrong. But I am a college age student driving a big jacked up truck so I'm already profiled for being a hooligan.

Fast forward a little bit, gangs has become rampantly growing in my area there is a robbery or theft about every night here. Just last night a kid stole a car went on a high speed chase back in my neighborhood and drive the car into a house and ran.

So tonight I'm coming home a little late about 10-30. I live in a gated neighborhood of about 2500 people in 5 sq miles mainly all locals. I see a bunch of cops doing a rd block so I roll down my illegally tinted windows thinking I'm good because I'm 100% legal besides windows. I pull up to a very nice officer asks me for my license. Then I see officer D( I'm calling him that because I didn't catch his name.) just as the first officer is about to give me license back and say have a nice night officer D storms over and says he has pulled me over before for window tint and says to check my windows. So they wave me over to the side officer one comes over and gets my registration.

Then officer D gets his tint meter then storms over to my truck to check it. I don't play dumb I play nice. I tell him it's probably too dark and I'm ultra polite while doing it. He goes on to question me how the tint got on there and who did it and telling me its illegal to install illegal window tint(all while in a very bad cop type tone). He says window tinting is a misdemeanor and I can be arrested for it. If he pulls me again he's going to arrest me for it. He also mentioned that hes going to mark in the computer system that i have been ticketed for it twice so all the other officers know.Then he storms off to give someone else an ass reaming I suppose.

Officer 1 returns with a 50fine and 240dollar court cost ticket as usual.

I got to thinking my parents were behind me 2 cars that were in a vehicle that was just as illegally tinted as mine but they got no grief whatsoever!(Just a wee bit of profiling eh?)

So hypothetical question for guys here, so what if I didn't take the tint off? If I did encounter officer D again and he did decide to arrest me what kind of real trouble would I be in with a misdemeanor? Fine? Jail time? Truck being taken? I'm hoping the officer was a Sherriffs deputy.

The SCOTUS has upheld that you can be physically arrested for any violation, however few LEO ever take it to that extreme. If you know you are in the wrong as you stated, then you have 2 choices. Keep paying the tickets and risk possibly being arrested or remove the illegal tint and have it redone to whatever your legal limit is.

Oh, and it's not really fair to compare brake lights to window tinting. If you don't have brake lights, people could run into you. If your car has too dark a tint... nothing. I mean, yeah, you should probably ditch the tint, but I'll agree it's stupid.

Down here in Bama the tint laws from year to year come and go. So during the "ticket offseason " people tint em up. After a year and a half or so, they'll reinstitute the law. Thus giving them plent of money. I used to play the tint game run around, but after kids, I can't afford the harassment . Remove the tint, be a nice citizen , and maybe next time you get pulled. They'll let you off on that offense. I learned along time ago, piss of a Leo and he'll get you back!

What he said. You're playing a game you can't win; next time any officer pulls you over you'll get an expensive ticket and have to remove the tint anyway.
Peel it off and move on. Maybe get your windows legally tinted so when Officer Dick pulls you over with his tintmeter you're in the right.

Change the stupid tint. You could receive a citation in other states and jurisdictions as well.

If I were an LEO, I wouldn't want to walk up to a window in the middle of the night through which I could not see. Might mistake something innocuous as a weapon . . . know what I mean?

So I found out why officer D was soo pissed. My dad was driving my truck about 7 months ago and he got pulled(by officer dick). He got a tint ticket of course. Well, my dad has connections so he just got the ticket dropped without removing the tint. That put me on officer dicks bad side.

Thankfully in NC you can remove the tint, have it inspected by state trooper and get the ticket dropped. Im going to peel it off and get it inspected. I'm going to put the legal amount back on the 2 front windows. If I don't get harassed I'll put a little darker back on.

In the meantime I'm going to start researching all the tint laws in all states and see if we can lower the tint % to at least 20.

Sorry. Not true, the Texas Transportation Code specifically states that the two offenses (and only two)that you can't be arrested for are speeding and open container.
However, they are also forbidden to release you if you do not sign the promise to appear. At which time you will either be taken before the magistrate, or taken to jail to wait till the magistrate comes in (and your car will be impounded).

To the OP, by your own admission, you had been warned previously and ticketed previously. Personally, I wouldn't arrest you, I'd just cite you and impound the truck.

The law is the law. Screw the cop for being a prick and insisting on strict enforcement of a ridiculous law against a law-abiding citizen. But to make it easy on yourself, follow the law---lobby to have it changed, and file a complaint on the officer if you feel he's unfairly targeted you.

Officer Bob (you *coulda* called him that because you didnt get his name...) 'stormed over' because youre obviously learning impared. Youve been ticketed twice and refuse to learn that different behavior (ie, less tint) would result in better treatment (ie, no tickets).

Get a clue, drop the tint down a notch, and get less attention. Course the 'jacked up' truck aint helping your cause. Its an 'attention' getter.

If you change the tint to legal, and get a note from the doctor, then when you are checked next time and found to be legal, you could file a complaint for harassment against the officer. He would have absolutely no way to refute the harassment complaint, and you would get a little of your own back again. Then, you could get the tint changed darker, and the doctor's note would make it legal. Best of both worlds, get him in trouble and be legal at the same time....

Words of wisdom from someone that has never had to approach a vehicle when you can't see the occupants or what they are doing.

Also, how is unfairly targeting him?
It is an offense committed in plain view.
When someone rolls down both windows on a routine checkpoint, it's called a clue.

I don't do it just for looks. It's nice not having people looking into my truck thinking about what they are going to steal ie radio, rifle in back seat, pistol. Also keeps the truck exponentially cooler in the summer and cools off MUCH quicker. After having it in the summer I don't really want to go back to not having it.

They are rough down there. They tried to ticket me for tint in kitty hawk with VA tags once, didn't go over how they planned because I knew they couldn't ticket me. The officer was a prick about it, especially when he found out he couldn't ticket me.

I've been lucky here in VA. My silverado has 20%, my lifted F250 has 5%, and my wake the dead loud cobra had 20% and I've only been pulled once and it was in my cobra. State trooper checked it, started talking about my car and said have a nice day.

Next time don't roll up your windows, you don't HAVE to unless they have seen them up then and there. "I pulled you over for tint once before" isn't probable cause to believe you still have it on there.

Truck's not lifted enough if the average person can walk by and see what's laying in the seats.

Windows down, I think I'd take my day in court, officer did not have reasonable suspicion. They aren't allowed to stop everyone they ever caught drunk, or with drugs, or stolen properrty in the car, prior bad acts are not probable cause.

That out of the way, I'd pull it off, giving them cause is bad practice.

Funny you mention brake lights, in NC as long as you have one functional brake light they do not have probable cause to stop, the law/code was written brakelight singular, and has been held to that strict interpretation.

They did not pull him over for prior offenses.
He was stopped at a "checkpoint".
Depending on state law, once they have stopped you, they can check for violations.

If an Officer has prior knowledge of a habitual offense, I am sure that he can articulate reasonable suspicion that the condition has not been corrected especially in light of the suspicious behavior of lowering BOTH windows when approaching the check point.

I assume you can have legal lighter tint? If so go with whats legal it will still help with the summer heat as is your just asking for more problems. Unless you just have money to burn in fines court costs

Generally speaking, people gain experience in their business when they do it day in and day out.

It may be possible this officer has somewhat "calibrated" his eyeballs and knows illegal tint when he sees it.

Perhaps he'll be able to tell, without his tint-o-meter, whether or not your tint percentage is legal....?

My Super Duty came from Texas, and the previous owner applied some rather dark tint. I have never gotten so much as a sideways glance from an officer, probably because it's the very definition of "nondescript" (white paint, black plastic grille, painted steel wheels, stock ride height, beat-up cargo box). FWIW, this also makes it easier to surprise other drivers at the drag strip

Two other friends have cars that tend to attract more attention from the law (a second-gen Eagle Talon and a '96 Impala SS, both heavily modified, if it matters). They have both gotten hassled several times for tint of similar darkness to what's on my truck.

The two other vehicles that I own which are likely to attract the wrong kind of attention have stock window tint for precisely this reason.

The moral of the story is that if you have a vehicle which is likely to attract attention, it may be in your best interest to ensure that it is 100% legal from the standpoint of both equipment and the way that it is operated. I'm not saying that this is fair or just, but I have yet to see anyone successfully fight the system. One does not become Thoreau or Gandhi by spending time in traffic court fighting civil infractions.

Learn the law and use it to your advantage. I'm guessing that VA doesn't require that a vehicle have windows. Anytime you are in the jurisdiction of Officer D, keep those windows down! It sounds like VA only restricts the front windows from being tinted? So you dont have to worry about any rear glass that can't be rolled down all of the way. Install a hidden kill switch for the front windows. When Officer D asks you to roll up the windows to be tested, tell him the door switches aren't getting power.... Choose your words carefully. Don't lie, just don't tell the whole truth. I'm not familiar with inspection laws at all, but I would have to believe that a warrant would be required to search inside the door panel for evil black assault glass. What kind of meter do they use? All of the meters in AL simply fit over the edge of the glass and only test about an inch strip along the edge. If VA uses the same meters, you can have the installer trim the illegal tint an inch or so short and have a legal tint installed in the "testable" strip. When they ask you to roll the windows up for testing, only roll them up enough to expose the legal strip. The strip will look goofy, but Ventshades will hide it rather well. I'm guessing the "take it off and we'll throw out the ticket" deal is just a matter of the judge being lenient on first time offenders. If that is the case, you'd most likely be wasting your time trying to get any sympathy after so many tickets. If it isn't the case, learn how to install the tint yourself and order a roll of quality film. When you do the install, tint is dirt cheap. Just peel the stuff off, get the ticket thrown out, and lay new film. You may take a ride to the station if the guy has that big of a hard-on for you, but you won't go any further than a holding cell....

Keep in mind that all of that advice comes from a guy who spent 4 days and about $500 in fuel to get a $250 tint ticket thrown out, just because the officer was a lying bitch. I've not seen a single valid argument for window tint restriction since power windows became a standard feature on most vehicles. It's just another excuse to pull cars over and steal from the citizens.

By the way, leaving firearms in an unoccupied vehicle is fucking stupid....

My car had 5% tints all the way around for 7 years and I think in the whole time they were on I got warned about it once, never ticketed. Truth be told I'd pay the fine and keep the tints on anyway. Given what the tints cost, and how much the fine is, I considered it a minor financial/legal risk.

My favorite part is that many of the un-marked patrols have tints just as dark, and are in fact referred to as 'limo-tint'. So its OK for limousine companies, funeral homes, and law enforcement, but not OK for civilians.

I also look at tints as a privacy feature, and a deterrent against smash-n-grabs.
Here's a curve ball for you: How about all those vans from the 70's and 80's that had curtains? Nothing illegal about curtains right?

I thought road blocks/checkpoints were normal???

I've lived here all my life and we have 1 or 2 a month. Usually they setup somewhere where they can't be seen, or you can't not go through it by putting it on a 2 way rd with no turn offs. Usually they ask for your ID and or registration and make sure registration matches plates. From my experience they look and smell for drugs and alcohol. If they think your guilty they pull you over and ask to search your car with officers and maybe a drug dog.

I agree about (Official) vehicles of any sort having tinted windows and not citizens is pure BS...

That's hypocrisy at its best. All that says is that Im at a higher level than you. And the laws don't apply to me. With that being said, my truck has (Other than legal tint) and I feel my right to privacy is justifying my tint. I have been pulled over one time by this cop and I laughed in his face when he said he was giving me a ticket for tint. I sure as shit told him Ill be getting it fixed. (And I did).
Now when it comes to laws that actually make sense.. I abide by them and will take the consequences if I break them. But a tint law is PURE BS! Especially when the vehicle he pulls people over in IS TINTED!

Usually they ask for your ID and or registration and make sure registration matches plates. From my experience they look and smell for drugs and alcohol. If they think your guilty they pull you over and ask to search your car with officers and maybe a drug dog.</div></div>

Last time I checked the AL code, only windows of passenger compartment doors are restricted to > 35%. By that description, only the front doors of most shaggin wagons would have to comply. Although I think it only requires that a film, applied to the glass, allow 35% light transfer. By that definition, a curtain would be perfectly legal.....

Before 2010, AL only restricted the front doors of trucks and SUV's. I took a 2009 copy of the state code to my February 2010 court appearance. Lo and behold, the shit changed in 2010 and I had to reform my entire argument. I still got the citation thrown out because the factory glass of my 2008 Grand Cherokee rear doors was darker than AL law allowed. The kicker was that the rear door glass was manufactured with the tint and glass as one. Since there was no film applied to the glass, I was legal..... That or the judge got tired of seeing me

Now that I think about it, I'm pretty sure I was cited in 2009.... I must have the dates confused though. Surely I wouldn't have let that slip past me! Regardless, I quickly learned that the online pdf of the Alabama Code is worthless. I think it was last updated when Al Gore invented the Internet....

Power stroke I too drive a lifted truck with tinted windows at 5% it's my truck it's my choice. Just as seat belt laws can suck it as well, it's my pirogitive to wear or not wear my seat belt if the local LEO wants to pay my insurance for me I'll wear my seat belt until then I pay it I'll take the risk rolling 36" 15.50" wide tires I think I'll end up on the better end of the stick. BuT as a law abiding lightly bending citizen I ALWAYS give LEO's the benefit of the doubt. Especially at night I always roll my windows down and turn on the dome lights and place my hands outside the window so the officer can see them, I'd want the same respect givin the situation was reversed. As for the tint laws you ALWAYS have that ONE LEO that got picked on in high school got a tight shirt and a badge and has it out for the world. Just my opinion

I totally understand and agree! I know I'm in the wrong tell the truth and be as polite and respectful as I can short of giving him a reach around.

The only real problem I had with whole situation was the attitude and "vibe" officer D was putting off. You thought I would have had masterminded a dog fighting ring and had 7 dead hookers in the bed of the truck. Ill give him the benefit of the doubt maybe he forgot his coffee???

You been drinkin your eyes look cloudy!?? You been eatin doughnuts cuzzzzz yours look glazed over. I'm gonna say this prolly gonna offend some people but I haven't met a LEO I like. Period DNR guys around here are worse they got
Time to write bumper law and tint violations but anytime there's something of actual importance happen what do we hear on the news? Local authorities need YOUR HELP finding a suspect blah blah blah sob didn't have any problems finding the guy with a nice truck not out harming people

You're thinking wrong, but I'm not going to waste any substantial amount of time attempting to inform you why. Let's just say that if you make a habit of driving around a vehicle with a high center of gravity and don't wear a seatbelt, then your greatest risk of death in a vehicular accident may come from getting crushed by your own truck after being ejected from the passenger compartment.

Although I always wear my seatbelt. I don't agree with it being law. Until the Govt (State or Feds) assist me in buying my vehicle and paying my insurance, then they can dictate how I use my personal property.
And before yall get sour and bring up (Well your on (State or Federal) road... My response to that is that MY MONEY paid for those too. So I see it as the Govt is driving on MY ROADS.
