So I am going to be moving within state (intra and not inter) to a new city. I have several registered NFA items. I called NFA Branch and asked for the Statute or Regulation that spells out the notification requirements. I spoke to two "specialists" who both used words like "we like to know", "it would be best" and "the government wants to know", etc. Neither was able to quote me the exact requirements/format for the notification. Neither was willing to figure it out either.

Can anyone cite the specific statute or regulation?

Before it starts. Yes, we all know NFA Branch is messed up. Yes, I fully intend to notify them and want to comply with the law. Yes, we all have horror stories and I am sympathetic but for the purposes of this post I really just need the actual cite so I can get this handled.

I can't provide you with a specific regulation/statute governing INTRAstate moves because no such regulation/statute exists.

The only thing that I've seen governing INTRAstate moves is what you can derive from the Form 1 language which specifically says:

"Change of Description or Address: The registrant shall notify the NFA Branch, Bureau of Alcohol, Tobacco, Firearms and Explosives, 244 Needy Road, Martinsburg, WV 25405, in writing, of any change to the description of the firearms in item 4, or any change to the address of the registrant."

Just write a letter to the Martinsburg branch noted on your Form 1s of your change of address within your State and ask that their database/records be updated to reflect the correct/new address.

The only specific statutory/regulatory requirement for notice of changes of address involves INTERstate moves which implicates 18 USC 922(a)(4), 27 CFR 478.28 and requires completion of a Form 5320.20.

Excellent answer. I missed that on the form. Thank you very much. Wonder why the Specialist couldn't cite that?

BTW, she tried to instruct me to use a 5320.20 and was confounded when I asked why I was using an Interstate form for an Intrastate transaction. Not sure the difference was getting across. I will go the letter route I think.

Anyone got their fax number to save me having to call again?

I just went through this. I was directed to fill out a 5320.20. Lady mentioned to place date of move in 'From' and 'To' in box 3 for Dates. Then, 'Permanent Change of Address' in box 5 for Reason For Transportation of Firearms. And 'Personal Vehicle' was listed in box 8 for Mode of Transportation.

I also sent a letter explaining things better. I just received my approved form 5320.20 back yesterday.

Filling out a 5320.20 in that instance is just @#$%ing stupid!! The damn form itself specifically outlines that it is to be used at times of transporting an NFA item INTERstate or in temporarily transporting an NFA item to a FOREIGN country!! Making you complete one for a move within the state of WV is just another fine example of how your tax dollars are being wasted (and time being wasted by you and examiners/trees being killed/ink being wasted/etc.) on needless, bull$#!T paperwork!!!

I know what you mean ORD. Two different people at the NFA directed me to send a 5320.20. What kinda convinced me to send it was that 'Permanent Change of Address' was listed as an example for 'Reason for Transportation of Firearms.' I agree that it was pointless to do for a move within WV, especially since the NFA Branch is in WV. I just wanted to cover my rear.

My situtaion is somewhat different than a normal 5320.20. My 5320.20 went pending shortly before my Form 4 was approved. I read that the 5320.20 is usually approved within a week. I called a week after mailing the 5320.20 and a lady at the NFA said that both forms would be approved at the same time. Both Form 4 & 5320.20 were approved 11/7/12. They mailed my 5320.20 to my old address and my Form 4 to my dealer.

This is an area of ambiguity that needs to be addressed by the NFA with a set-in-stone guideline.

The FOrm4 is supposed to go to the dealer, then he completes the transaction by giving you the approved form4 and item.

I have never had a 5320.20 approved in under 1 month, mail or faxed in.

I fully understand about the Form 4 going to the dealer. I'm just trying to figure out why my 5320.20 was mailed to my old address the one listed as 'Transporting from'.

I guess the person mailing it didn't understand it was for a permament change of address and assumed I was still located at my old address considering most people submitting a 5320.20 are still located at the 'Transporting from' address.

Because 5320.20's are always sent back to where they came from, regardless discussion one has on the phone, its policy and besides that most people file the form BEFORE they move, so its not an issue.

No misunderstanding anything its a matter of policy.

Gotcha, I didn't know that was policy. This was my first NFA item, and my old address was my parent's when I was still at home when the Form 4 was submitted. No big deal, I was just curious, but it makes complete sense now. Thanks.
