Recently started seeing a woman who was divorced a few months ago. Her ex has a truck in her name and won't assume the loan per the decree, left the state ect. Court and loan company told her GFY. She's broke as a joke and can't afford the payment or an attorney, what are her options?

I had a colleague, this is a good 15+ years back (early 2000s), whose wife emptied out his bank accounts and took off in his Benz. She was "run down" for divorce court proceedings by shutting off their On-star, I recall that for a fact. And he was based out of California. TBH, that's why I don't believe the "cops" story or am convinced she is being 100% honest with you.

Stop fucking around, report the truck stolen and have his ass arrested. If it's in her name it's her fucking truck. If she refuses, dump her ass and let her and the shitbag remarry.

My advice to her would be report it as taken without permission if his name is not on the registration.

Otherwise, she should call the finance company and tell them that she's not going to be making payments any longer, where she thinks it may be and they should go and get it sooner than later.

No direct experience but my guess is they will auction it / sell it and she will be responsible for the difference plus have the whole non-paying of a loan thing.

QDRO. It stands for Qualified Domestic Relations Order issued by a court.

I used to be a Financial Advisor. If the firm got a QDRO, his account would get retitled to her account. The joint accounts would get split into two accounts, his and hers. Equally or whatever proportion ordered by the court. Automatically.

The same QDRO that got his name on the truck title should get his name-and his name alone-on the debt, retroactive to the date of the order. It doesn’t even matter that he never applied for credit, nor did the finance company loan him any money.

I would have assumed that her attorney would have sent these out to the custodian of all the accounts and assets that were apportioned by the divorce decree.
 
On second thought, maybe I should move her in and support her through the tough times she's having?
