Suppressors Ordered my first one tonight.....

Ordered my first suppressor tonight. A friend became a FFL and dealer. Now the wait begins. I did have a few questions that you fine folks could potentially answer.

**Note I am aware none of the response are considered legal advice****

Can I start my trust online at Silencer shop or at one of their Kiosk ? I believe the answer is yes even if I dont order a suppressor from them. I am going to contact them directly tomorrow for an answer.

Same for the tax stamp......

So have you not created a trust yet? or filled out your form 4? If yes to either of those then "the wait" has not begun yet lol...

I would contact Silencer Shop. Only advice for a trust I would give is make sure it:
a.) beneficiaries hold no power, or else you'll have to do a responsible persons form for them every time
b.) make it so you(the grantor) can change or modify the trust at any time. This allows you to literally fit the trust document to your needs.

There was a rule change at the atf back in 2017, if you go the trust route now everyone in your trust will have to get printed and photo’d when you submit your form 4. Its almost not worth going the trust route anymore save for estate planning purposes or sharing your items with trustee’s.

Unless you have the ability to modify your trust...

My trust clearly states the beneficiary has no rights to the property of the NFA items and therefore does not need a Responsible person form filled out. I also have the ability to add and remove co-trustees as I desire. When that rule change happened, I took off my co trustees when I got my next suppressor.

I've also changed the address, changed beneficiary, took someone off my trust in every facet, added and removed co-trustees and my forms have gotten approved.

Theres still, IMO, a great benefit to doing the trust route.

OP...personally I don't like the single shot trust things. Just spend the $100-200 to get a legitimate NFA trust made and you're set for the rest of your life.

I am doing a trust. We have other property and a vehicle we will add to the trust at a later date.

I will add my wife and she will do the photo and fingerprints.

I have a trust but, after the 2017 change, I did individual forum 4's for the last two cans I purchased. Honestly, it's easier and in the case of my last purchase, a little faster. Plus, you can do everything right at the kiosk and then... the wait begins. Good luck sir.

As an individual you show up to the kiosk, do your prints and photo, and submit. As a trust, you gotta round up all your trustee’s, get em in front of the kiosk, and have them all get printed and photographed. In my case I have trustees in different states, the logistics of adding any more items to that trust are insane.

I've done a form 4(person to person) and form 1 myself, then my most recent Form 4 I went to a local place that specializes in FFL and NFA transfers. He had everything all ready and barcodes on shit, app on his cell phone for passport photos. I already had a bunch of ATF fingerprint cards ready.

Some Silencershop dealers have a kiosk for doing nfa transfers, electronically scans your fingerprints and submits your paperwork electronically. Pretty convenient way to do it, but doesn’t really make much difference.

You might want to reconsider adding vehicle and other property to a gun/nfa trust and just do that separately.

It was my thought that if you get a lawyer to write it properly, it should be fine with both.

Never a need for any new trustees to provide fingerprints as the trust only controls the single item and just adding trustees does not require their fingerprints to be filed.

Thanks for the explanation of that. I guess I thought once the single shot was done, it was done, and could not be modified. But I guess that might make more sense in certain instances to just do a single shot for every NFA item.

It can never be modified to contain any other NFA items because there is only the one singular item allowed. Once it has been approved you would still enjoy all the benefits of a regular trust going forward.

You could also start out with multiple trustees when first applying if you so desired, but in this case all would have to provide photos and fingerprints for approval.

My NFA Trust is written with a contingency Trustee clause. Meaning that the designated person only becomes a Trustee in the event of my death or incapacity, no special documents required...and the ability to add or remove Trustees as designated by me at any time. I think there are ways to protect yourself and others, still keeping things simple, but have to be included in sections of the Trust. Of course this is not any legal advise just my experience. YMMV!

Just forget you ever bought anything. One day, the NFA Fairy will show up to your FFL with a tax stamp enclosed in an envelope, and then your FFL will call you a month later saying he forgot your stamp(s) arrived.

My first two cans took 100 days for approval. That's out of the ordinary but I've heard of a lot coming back recently in under 120 days. I think the ATF is trying to shrink their average processing time by processing recent submissions and putting off the existing ones. /shrug

Yeah you can check your account on silencershop and it will be under the order details i Think. If I remember correctly you might get a email with a notification that your check was cashed.
