wanted to know if any of can give me some name's and #'s to attorneys that can set up a revocable living trust in Texas. I've been reading that some that used the do it your self software's(don't know the name) have gotten approved but then confiscated because the info was wrong. I would rather pay up and be on the safe side then regretting it later. I've tried calling around but when I explain what I'm trying to do, they have no clue. I've used the search here on the hide, yahoo, and google and have not had any luck. Thanks in advance

Last week there was an issue where an individual was contacted by the ATF in an effort to seize his Title II firearms because of an irregularity with his Trust. The creators of these programs did not anticipate that individuals would be using the documents in situations that could result in criminal liability.
You may choose to have the trust reviewed to determine if the trust is valid, or reviewed to see if there are issues with the NFA that are not dealt with in your trust, but either way it is important to have your trust reviewed by someone who is familiar with estate planning as well as the NFA.

I think there's a 2009 or 2010 version now, but the CD is all you need.

I've purchased a bunch of cans and 3 SBRs so far with it and once the trust is up and going it's ridiculously easy to go the NFA route. I would think the ATF reviews the trust before they approve it the first time. Maybe I'm giving them more credit than they deserve. God knows the ATF does change it's mind from time to time about various issues. BTW I'm NOT in TX, but the software makes you choose what state you are in and then asks for the necessary information.

Lazy is going to stop by his office tomorrow and hopefully get it going. That is who I use. Good personal friend of mine. When you get a trust done by Sean, it's not just a trust you get out of Quicken Willmaker. It's specifically worded for firearms. Sure, you can get it done cheaper, but I like to know for a fact that mine is going to be done right and not have any problems with any gov agency. I have recommended several people to Sean to get their trust done and all of them have been extremely happy. The security of having a lawyer doing the paperwork for you, and the added benefit of having him being a C3 dealer is also a huge bonus. One stop shop. Trust me, you don't want a gunstore doing a personal legal document for you. lol

Don't take my word for it. Search around, Sean is probably one of the most well known people who do these day in and day out. He has helped other lawyers set up their own templates in other states too. I have done 3 transfers using my trust and about to do 3 more before years end and don't expect any issues with my trust or any of the Form 4s that I will be submitting.

Do what everyone else does, dont waste your money on a lawyer for the trust. get quicken will maker and fill in the info. then take it down to the post office and have it notorized, you sign the rest. Make your exhibit A.
Show both to a lawyer and have them sign a letter of good standing for you, youre set. ive had mine for years and have a lot of items on it.

+1 in using someone who has done them professionally. The fee is well worth it to me. When you think how much you wasted on worthless stuff over time, the fee becomes relatively inexpensive.

I have the trust on my site and am not responsible for its use.
That being said, it has been reviewed by several attorneys in the field and see no problem with it providing you follow the proper laws regarding trusts in your state.
The Attorney recommended in this thread has posted negative comments on other boards where my trust was passed on to others. I guess if I was an ambulance chaser and bending folks over to the tune of $500 a pop I might have some motivation to do the same.

+1 for Sean Cody, he is no joke. I did my initial trust with Willmaker, and decided that I was more comfortable with having a real attorney draw up the specific documents and amend my trust. The peace of mind was was worth the high cost of admission for me. I'm busy enough with work and family life, and the last thing that I need is a hassle from the government for shoddy trust work.
The NFA world, I am quickly finding out, is quite fun. Pay someone to do it right so that you can enjoy the NFA items without any worries.

I just remember you as someone who is a legend in his own mind. Last I remember, you were put off by a Dealer actually offering free info to help the NFA industry and posted comments like you thought my free trust offering was suspect.

Sure, you can get it done cheaper, but I like to know for a fact that mine is going to be done right and not have any problems with any gov agency. The security of having a lawyer doing the paperwork for you, and the added benefit of having him being a C3 dealer is also a huge bonus. One stop shop. What makes your Trust Transfer worth $500.00? I think I may raise my rate from free/$50 to $250.00. Pay my inter office Attorney a reasonable $50 for a back pat/thumbs up to the transferee, and pocket the rest. Folks would think I was robbing them after seeing your Rates.
BTW, all jokes aside, even though you are an elitist in your own mind and look down on the working folk, I would still take in your gunsmithing work with open arms. I might even do a quantity discount if you need a few barrels threaded or actions trued/rebarreled.

Contact Rhett at Hooper Ordnance in AL. You won't need a lawyer with him. He provides the form for the Trust and walks you through the process. I just got two cans by just using the Trust he provides and then he did everything else with the Form 4, etc. Very quick process. I've gotten four total cans through him. First two were via the Form 4, LE sign off, photo, etc. Recent two were via the Trust.

I stand by that comment. A dealer, practicing law without a license, in Texas is committing a criminal act. I don't know about your state, but I bet you are skirting the UPL issue and I bet that UPL in Alabama is a criminal act.
I can say this:
A dealer, who is not a lawyer, that prepares trusts for customers, is not only practicing law without a license, but if something ever goes wrong, that dealer might be striclty liable for the damages that his actions caused.
As a lawyer, it would be a real easy case to make against the dealer in a civil or a criminal lawsuit.
Why would a dealer/gunsmith take on that potential liability to make a sale? Ask yourself that.
Are these dealers so desperate to make $200.00 to $400.00 on a sale that they will put themselves or their customers at risk?
The facts are the facts. I know Texas dealers do this. If a dealer asks me about the issue, I explain my take on the issue of UPL and dealers providing trusts.

There's a lady in Houston that specializes In NFA trusts. She charges about $600 ($500 if military). I went with willmaker because it was pretty simple and the mil doesn't pay alot.

So you're saying any person cannot just up and make their own trust? They cant buy a program, follow the instructions, have it notarized and it wont hold up? Or are you saying a C3 dealer cant make a trust for you, or even assist you in getting one done?
I will disagree with some of that. You make it sound like a lawyer would have to set up every angle of the trust and then have it amended. I think thats another way for lawyers to make a quick $500.00 and stroke their ego that they know everything about NFA items.
I also find it saddening that you as a lawyer and firearms enthusiast are on here talking down to people acting like your the king of shit mountain. If you use Quicken, Hooper's offer, or any other program, you should always have it checked by a lawyer in your state and this is always recommended.
When the head LE in our county started sending people to my office after he refused to sign form 4's, for me to tell them the legal way to get c-3 items without his signature, it became neccessary to provide something to people.
My lawyer did my trust. I send people to him and other lawyers who work trusts and who found it easy to use one that was already done and legal.
Other Trust lawyers have checked out the trust and simply changed the names on it and verify the trust is legal, they sign off on it for a minimum fee based on the number of certified copies you get from them with their stamp on it.
At some point, enough people in this area wanted the information, Hooper is in the area, so he gives out a copy of a fill in the blank trust, prepared by a lawyer in Alabama, to his customers, with the recommendation they have their lawyer look it over before they use it.
Thats not a shady dealer tactic. Its not a tactic to entice people to buy. It is helping customers who don't know better when the sheriff refuses to sign, instead of sending people to internet boards where THEY DO GET BULLSHIT advice from people who don't know.

BINGO! You hit the nail on the head. This guy comes in here crying foul but wont offer up any other advice but running his mouth about how "he's a lawyer and knows" bla bla bla. The scare tactic is an easy way to get some poor blue collar guy to fork over $500.00 for some forms that you can do yourself for about $40.00 total cost. AND THE BATFE has approved thousands of forms under them, if they called it suspect they would question you because guess what? they have copies of your trust and exhibit A.

If you want to use Quicken or Legal Zoom or do your own trust from scratch, that is fine. It is a free country as I have always said so.
I do not use scare tactics to sell my trusts. Call me, I will tell you that on the phone.
Hoopster is preparing or providing a trust for for his customers. If something went wrong, he will be liable and get to pay for his screwups. It is also close to UPL. If he actually prepares the trust for a customer and isn't a lawyer, it is UPL which is a criminal act.
That is simple. Its bad practice for a dealer to do this on the dealer's side becasue it is a liability that the dealer simply doesn't need.
If the customer doesn't want to hire a lawyer to prepare a trust, he can do one himself. If you read my posts which have been conveniently quoted, I never say that the customer cannot do a trust through legal zoom, quicken or go to the law library and get a form out of a practice manual.
If I prepare a trust for you, I am available to answer your questions, deal with the ATF if there is an issue regarding the trust, deal with your dealer if he belives that a trust isn't a valid form of NFA ownership, help with your forms and generally be a phone call or an email away if you have a concern.
If you don't want to pay me to prepare a trust, that is fine. Hoopster's problem is that I criticised his povision of a trust form on several levels.
1. Dealer liability
2. Unauthorized Practice of Law
3. Even if that trust form is valid in Alabama or wherever he is, that doens't mean that it is valid in all fifty dates and Hoopster is putting it out with the insinuation that becasue his lawyer told him it was good in Alabama, everyone should feel free to use it in whatever state tey want to use it in.
Hoopster, instead of considering the potential that he is doing his fellow forum members a dis-service and practicing law without a license, decided to take my comments as condescending. Hoopster's ego simply refuses to accept the possibility that what he is doing is ignorant from a businessman's standpoint nd ossibly illegal in his state.
Since I am not a lawyer in his state, I do not know for sure that what he is doing is illegal in his state. In Texas a non-lawyer dealer who prepares a trust for a customer is practicicing law without a license.
Since I am a lawyer and I am familiary with general tort law, I can say that Hoopster is opening himself up to a lawsuit if something ever went wrong and I don't understand why he or any dealer would do that when even if he hates all lawyers (except his pet lawyer), why he doesn't just tell his customers to use legal zoom or quicken and remove the possiblity of a lawsuit?

Well . . . I hate to tell you this but it is the jurors who didn't exercise common sense and rendered teh verdict. You can blame it on the lawyers all you want, but the jurors are the ones who weren't savvy enough to just say no.

If the dealer isn't an attorney, he cannot prepare a trust. I see no reason why he can't say that the customer can do a trust through Quicken, Legal Zoom or hire an attorney to prepare the trust.

I don't charge $500 to amend a trust that I created. I never said that the grantor had to go to a lawyer to amend the trust. In fact, I never said that anyone had to have a lawyer prepare the trust. I said that dealers who are not lawyers are practicing law without a license when they create or prepare a trust for a customer I also elaborated the statement by saying that the dealers are taking on unnecessary liability when they do what Hoopster is doing. I thought that was clear and simply stated.

Do not address me by my first name, you havent earned that. But your name however is very fitting Mr. Rat.
And as far as your scare tactics you make it sound like if we dont have a lawyer prepare our trusts the ATF will kick our doors in. Thats false. I have more friends going the trust route then I can keep track of. They are all doing just fine and like I said earlier the ATF has copies of your trust on file with every piece of paperwork you send in. Pretty clear that if there was an issue they would be all over you or your next forms would be declined or you would be sent a problem form.
