I guess part of the issue is there were some people tortured by the CIA guys who wound up dead and a lot of stuff done under the table by the CIA on behalf of our government. Quite a few other of our Allies were involved in some suspicious activity with the whole CIA plan to kidnap, transport and torture people all around the globe if we felt it necessary and when it got exposed that they were in on it despite them publicly denying it, they now had to go find a way to try to wash their hands of it by making a big stink about it being all our fault.
I'm not totally sure if it makes any difference what the ICC does, it's kind of a Victor's justice kangaroo court that only applies if you sign up to agree to be subject to them. I seriously doubt anybody wants to try playing the kidnapping and renditioning game against us openly so even if they get upset at some Americans, good luck sending anything more than a sternly written paper.
