Either "all men are created equal and endowed by their Creator with certain unalienable rights" or they're not. This includes the ones who haven't been born.
Either rights are bestowed upon us by government, or they come from God (Creator if you don't believe in God). There are some things that just aren't subject to a 50% plus one majority vote, and LIFE is one of them.
If you struggle with these questions or find yourself giving the "but, sir" answer, you need to pick a team. A government that will not protect life, especially innocent life, is not fulfilling it's primary reason for being.

Ive given that quite a bit of thought.
I feel every compassion for this individual and feel she should receive every bit of assistance we have, but the bottom line remains:
The thing in her belly is a LIVING HUMAN BEING and is entitled to every right and privilege given us by (God) if there is one, and spelled out by the Constitution;
A living human being.

My only thought is that it there are some grey areas, and even if it is a small portion, it will happen. Maybe a hearing would be a common ground? Whores, Prostitutes and porn-stars shouldn't get the green light, but an innocent girl like the above scenario should at least get a chance.

You are correct about states pushing their 10A rights. It is happening in many areas including this, the legalization of pot, the 2nd amendment....
In this case, it will be interesting to see how SCOTUS rules. Which amendment wins? The 10th amendment vs. the supremacy clause (Article 6, Clause 2).

You and her get drunk and get frisky, you go back to her place. You and her engage in hot steamy sex without protection. After incredible sex you pass out. While you're sleeping this doctor sedates you and then connects her 6 year old daughter's failing heart to yours. She has cracked open your chest and connected a piece of plastic tubing to your aorta valve. You wake up and you are sewn up and have a six foot tube connected to your chest and you are now supporting YOUR life and the little girl's life. The hot doc say, "hey no worries......I have a heart transplant for her scheduled in 8-9 months and I will remove the tube from your chest at that time. I just need to use your body to support hers." She continues "I know it might be a hardship and you might get sick, you might have days you can't get out of bed, working is going to suck for you with her tagging along, toward the end of all this you might even experience the worst pain in your life while I remove the tube, but hey you signed the contract last night while you were drunk." It would likely come down to what my father called "12 lunkheads on a jury."
If she reports it right away, there would be no need for an abortion, the medical field has other methods than the morning after pill an they are 100% effective. If she chooses to not report it for whatever reason, she made a conscious decision to do that. Once there is a heart beat the decision is no longer hers, same as incest.

I actually have a friend who is the result of a violent rape, whos mother carried him to term. He is certainly happy he is alive- as am I. He really helped out at at point in life when I needed it.. I'll be the first to admit hes a bit messed up over it- just as anyone would be. Hes a good human being though, and the world is better off with him in it.

Less laws doesnt mean no laws. There are very very few things the federal government should do- protecting the liberty of its citizens, securing our borders, negotiating foreign agreements, maintaining a military, and settling matters of commerce between the states. Thats it. Its a short list. Protecting the liberty of its citizens is on the list though.
Jefferson called them "natural rights" in specific deference to Judeo/Christian beliefs about morality and the meaning of life not being necessary to still believe that human beings are inherently different than all other creatures, and by virtue of consciousness (what we are rather than who we are) these rights are fundamental to our condition.
Certainly belief in Christianity allows you to arrive at the conclusion that we are granted "Rights" by God almost by fiat, but the important point is that one gets to the same conclusion by either logic or faith.
Lots of solid win in this thread. Scientifically there's no question that a zygote is alive and a unique human being. It all comes down to a question of where that human being becomes a legal person, and it is virtually the same argument as the "scientific" argument for slavery only the argument for slavery was a lot more compelling than the argument for randomly murdering humanbeings.
