Well, I finally got through the entire trial today, and it just got nuttier than where I had left off earlier today...
Disregarding the flagrant violations that angered the judge, Binger just went off the deep end with all kinds of craziness. Just a few examples:
Grosskreutz would have just used the pistol from 15 ft. away from Kyle, so the fact he was standing right at Kyle's feet with a pistol, means Kyle should have realized Grosskreutz wasn't really going to use the pistol, and was not really a threat, because he was so close now.
After having chased Kyle down the street, Kyle falls and gets attacked, then Gaige rushes up with a pistol, it was Grosskreutz that should have felt threatened, because Kyle just fended off several attackers, then aimed his rifle at Grosskreutz when he approached pistol in hand.
Because Grosskreutz was angling the gun toward Kyle with just one hand, and was not holding it with both hands, in a spread-legged, forward facing stance, means he wasn't really aiming it at Kyle.
When showing the photo of Grosskreutz in the fake-surrender/hands up (photo not shown, but I'm assuming it was the infamous stillshot we're all familar), and Kyle's rifle is pointed down, low-ready, he repeats at least three times that Kyle was clearly aiming his gun at Grosskreutz, aiming at his body, rifle was aimed at Mr. Grosskreutz. (ETA: Poor Kyle, he kept looking at the photo, looking back at Binger, confusion all over his face, because the rifle wasn't aimed at Grosskreutz, yet Binger kept saying it was, and I'm sure he's thinking WTF?)
It was lunacy, gaslighting, unhinged. I've no more words...
