In 1946 the Supreme Court acknowledged that the air had become a “
public highway,” but a landowner still had dominion over “at least as much of the space above the ground as he can occupy or use in connection with the land.”
The Supreme Court declined to list an exact elevation in regards to privacy aka ownership because "connection with land" is different in every situation. But we know that everything 500' ASL is for piloted aircraft which means drones have the airspace from lets say moderately 85' to 400'.
Be careful when you start talking of "Shooting" down drones because FAA has classified most of them as aircraft IIRC.
Homeowners have taken drone owners to court for invasion of privacy and lost under the same concept of it is not different than google autos driving by your home with 360deg cameras monitoring and recording your entire street.
Now...that being said I have some ways for you to cause the drone pilot to loose control.........
