Rifle Powder, Hazardous Material, FedEx. Where's the label?

Hello the Hide;

I just received a box of powder through FedEx from a private seller. He added a $25.00 cost for hazmat. OK, we all know that's UPS/FedEx policy.

But as I look at all sides of the shipping box, I see no hazmat sticker, and nothing noting hazardous material on the shipping label. What gives?
Is the hazmat label stealth, or did I get taken for a $25.00 ride??

If you were happy with the price to begin with, I would keep the powder and let him keep his $25. If he shipped powder without declaring it and pocketed the $25 that is on him. If you expected him to ship it without declaring it that is on you.

BTW-- he is very foolish if he did ship without declaring it. the risk is really not worth the $25.00.

Was WAS NOT happy with the price including a hazmat fee. It is though, what is necessary to comply with shipping regulations.
I was told I was paying a hazmat fee. If I paid for an extra fee, and the seller did not comply with regulations to pocket an extra $25.00, why should I be happy with that

Now I need to be able to confirm it was/was not shipped hazmat before confronting the person.

With FedEx hazmat, there will be a red plastic pouch on the box where the hazmat info is. The shipper should removed the paper to see what kind of 'hazmat' they're handling, but sometimes it's unopened, sometimes it's open w/ the paper still in there and sometimes the paper is gone.

I know a guy with a shipping company, he ships hazmat a lot, one of his guys forgot the sticker once cost him $60,000. The next fine is double. If you received it safe it was shipped safe, the next one might not be. I would contact the shipper seller and warn him of that fact. And leave it at that

To my knowledge private sellers can't ship Hazmat without a liscense which is an enormous hassle, and which no one has that I know of except delaers. Probably why there weren't any stickers on it. Guy took it to ship realized the hassle and just decided to keep his mouth shut and roll the dice. I don't even look at any private sales involving powder or primers for this exact reason, unless they are FTF.

I am taking the still sealed box to work today and beginning the process of contacting FedEx to report the shipper for HazMat violation.

According to email from the seller, who is dtibbals from here on the forum, the price I paid included shipping and HazMat charges. I received the rifle powder in a plain box with absolutely no HazMat placards, markings, or proper forms.

Regulations state "shipments of smokeless propellants in quantities not exceeding 100 lb. (45.4 kg) may be reclassed for transportation purposes as flammable solids (Division 4.1) when packaged in accordance with the U.S. Department of Transportation Hazardous Materials Regulation (49 CFR, Part 173.171), and shall be transported accordingly."
Because FedEx and UPS handle packages from so many shippers the HazMat rules gives the employees that handle those packages a chance to go home at the end of the day. FedEx and UPS handle so many different products that in case of a fire will produce a very high temp fire. The HazMat labels and forms that travel with those packages tell the employees what they are dealing with if everything goes south. There is a very real extra cost to handle those packages between the training, auditing, special procedures, & record keeping in handling them.

Email communication between myself and the seller dtibbals is unproductive as the seller is just focused on accusing me of trying to get the powder at a cheaper price. He offers no explanation as to why HazMat was missing on the shipment and where the Hazardous Materials fee I paid went to if not to properly identify the shipment. His only resolution offer is to have me ship the entire quantity back for a refund.

I must therefore sadly conclude that the seller padded the sale price with the extra HazMat fee without any intention of declaring the hazardous materials to the shipper, possibly to increase his sale by a modest sum.

Future buyers should beware of transactions with dtibbals, especially with respect to buying reloading supplies that must be shipped HazMat. Remember that if a shipment is found to contain hazardous materials without proper markings, not only does the shipper incur fines and penalties, but here is also a clause in the law saying if you knowingly partake in the action, then you can actually serve jail time.

I would strongly advise against buying something from someone you know will break the law.

I think CMH might be right in that private individuals cant ship hazmat without the proper licensing. I believe the "worst" we can ship is dangerous goods(i.e. loaded ammunition).

I have shipped ammo as dangerous goods on many occasions and FedEx plasters DG stickers ALL OVER the box for you as well as a special plastic pouch with the dangerous goods paperwork(which has to be filled out in triplicate and printed on a color printer).

I am 100% positive that FedEx would have stuck big hazmat stickers ALL OVER the box(if there werent any already) as well as a pouch with the hazmat info on it. I picked up primers from Midway that were already setup to go out on a truck and they had hazmat stuff all over them. I assume Midway puts all the labels and such on everything just to cover their asses.

The other side of the story.....

Well since fnbrowning has decided to use my name I am left with no choice but to respond. Like a pancake every story has 2 sides so here is all the details of what has happened. For full disclosure I saw this thread last night but since my name wasn't mentioned I didn't feel it was worth a back and forth debate.

After my last email with fnbrowning yesterday it was clear that with all his huffing and puffing the bottom line is he want's $25 back. His last email which contained threats I decided to send an email to lowlight and give him a heads up. I included every email that has gone back and forth and asked for his advise since I have respect for Frank and for the hide members. As of right now I haven't heard back from lowlight. If he decides to be involved or give me advise which I asked for I will gladly follow his advise.

As you will see with all of our emails more then a few times I offered him a full refund and to cover any shipping cost back to me. He refused such an offer. There is not a company he could buy from who would 1) offer a refund on powder, primers, ammo etc and 2)offer to cover the shipping cost.

I went one step further and told him and also lowlight that if he would like to send it back I will offer it for FREE on here to any hide member who wants to pay the actual shipping!!! It isn't about the money, it is about dealing with someone who is impossible to please. He of course refused that so he clearly wants and needs the powder (if you look at his threads and post he is complaining how hard it is to find powder).

So before you spend your time reading everything let me break down a few simple points.

1) My original thread which is referenced below stated very simply 6lbs of RL-15 for $198 shipped. I didn't say if it was next day, ground or 2 guys and a camel simply shipped.

2) Look at the time stamps of all the emails, my typical response time to all his emails was within 3 minutes start to finish of this whole ordeal.

3) I received his payment and shipped same day.

4) He received the powder in 2 shipping days (much quicker then 2 guys on a camel).

5) He started this thread 2 hours before contacting me about the labeling of the box.

6) I took the box to fedex and had them ship it. It was the end of the day right before pickup time and they where slammed! The middle eastern lady who barely speaks english packed and charged me for the packages I shipped and I left. Did they put a sticker on it? I frankly have no clue I didn't hang around. Did I pay for it? I don't know, I paid a total for everything and left. Guess that is my fault for not being anal but I had stuff to do as well.

7)His argument as you will see in his email is that he feels I up charged him on the shipping. I refer you back to point 1. I had a simple price including shipping. He references an email exchange where my response to him asking me to recalculate shipping (which is asking me to lower my price) and I said no, you need to remember that hazmat is $25 of the cost.

So that simple line is what he has his panties in a bunch about. At the end of the day he had rapid response from me on every email, shipped same day I received his payment, shipped the product he purchased as promised which he received. He feels I owe him money so I offered to give him all his money back plus the shipping so he isn't out anything and I will give the powder away for FREE on here. He refused.

He holds me responsable for not insuring Fedex but an ORM-D sticker on the box and for that sure I will take responsibility for it but at the end of the day he has his powder. I can't do anything to fix the fact a label wasn't put on the box. He can take it up with FedEx most likely the lady who processed the order will get reprimanded if they do anything.

So now that everyone here has wasted time of their life like I have had to that we can't get back enjoy reading all the emails and you can form your own opinion. Unless Frank tells me different I am done with this and will not continue to waste more of my time with the ridiculous buyer.

Now, if you refuse to do that, we've got a problem. Then I have to assume you've busted regulations, and put the shipper and my warehouseman at risk, to pocket the $25.00 you claimed was for Hazmat.
That is not going to be ignored. You have until 3:00pm tomorrow the 31st to provide proper documentation or a refund of the Hazmat.
If I do not get satisfaction, the box is still sealed, and I will use it to report the shipping incident, and oh, you can also forget about selling on the Hide again.

Sorry but I didn't break any laws. I went to FedEx who is licensed, they charged me for their service. It is their responsibility to apply any labels etc. If they didn't then that is on them, sadly the lady working there is the one who is going to take the heat. It is very possible FedEx will either one tell him oh well or keep the package and then he is out everything. That is his choice I more then once offered to take it back and give him his money back. But now that is off the table he can do as he wishes with it.

The powder came to me in a previously used box with a partially torn USPS delivery confirmation, from a shipper in Rialto CA to dtibbals.
What this proves is that FedEx did not pack the box, they don't re-use old boxes. FedEx packs in new boxes. Also the box is far too big for the powder. FedEx packs in appropriately sized boxes. Finally, what do you want to bet the packing material in the box is DIY?

Post the receipt. It will have a separate hazmat charge line.

From my understanding you can only ship ORD-M as an individual, not hazmat.

Something tells me you committed a felony (and are posting on a forum about it!) because the 'middle eastern lady' just took your box and rung you up. For hazmat you need to fill out a little slip; doesn't sound like this happened, therefore your package isn't hazmat 'certified'.

I'd delete this entire thread ASAP to save fnbrowning's man card, and your safety.
