So the move to deport him was made after the shooting stopped. The question raised was, does the lack of active hostilities nullify the power to deport under the Alien Enemy Act.

The answer was no.

"War does not cease with a cease-fire order, and power to be exercised by the President such as that conferred by the Act of 1798 is a process which begins when war is declared but is not exhausted when the shooting stops."

Did not see the interview, but the social media post is citing a Supreme Court opinion, and I provided a link to it above. In addition, the language of the Alien Enemy Act is quoted in the Supreme Court opinion. "Whenever there is a declared war . . ."

Words mean things.
 
He is probably relying on this language:

"or any invasion or predatory incursion is perpetrated, attempted, or threatened against the territory of the United States by any foreign nation or government"

But that appears to be a stretch, since there is no foreign nation or government action being perpetrated as an invasion.

Those are separate items from a declared war.

over my pay grade but something has to be done about these judges. my hope is that Trump ignores them and carries on. "the rule of law" is just not working for the American people,at least those with any brains. there are still the huge #s of deep state players,unhinged libs and the dependents on gov for their big salaries. what to do?

Yes, there is the word "or," but none of those conjunctive conditions are satisfied. There is no invasion by a foreign nation or government. There is no such invasion by a foreign nation or government perpetrated, attempted, or threatened. That is just fantasyland. Trump making a "proclamation" does not change fantasyland into reality. Note the word "and" before the proclamation, not "or."

That is a loser argument in court.

Trump needs to ignore these judges, it's all bullshit window shopping by leftists, find the most libtarded district they can and file a lawsuit. Keep deporting illegal alien gangbangers, let Elon do his thing, don't re-hire anybody unless it's actually necessary. Highlight the fact that Democrats want to keep illegal alien gang members in the country and Republicans want to keep them out, highlight that Democrats want to continue fraud in USAID etc and Republicans want to clean it up. But as it is, the Trump DOJ just filed papers in the Fifth Circuit a fews days ago arguing that gun mufflers are not arms and are therefore entitled to no protection under the Second Amendment.

This is the same position the Biden administration took in the same case.

No change.

And this is not bureaucratic inertia. It was filed after another filing about a month ago asking the court to hold while the DOJ reconsidered its options under the Trump Executive Order regarding Second Amendment litigation. After that month of delay, this is what we get.

So, to be clear, this is not a case of silence, or lack of action, or the Second Amendment not being a priority. This is a case of direct, intentional executive branch action after a period of time for consideration. That action is directly hostile to us, as citizens of this country, and directly hostile to our liberties.

And now just a day ago, Roberts publicly rebuked and rejected President Trump’s desire to see an out-of-control federal judge impeached for trying to stop the deportation of illegal alien gangbangers who have committed the worst crimes in our country.
