No different than "magazine repair kits", auto cards, assisted knives, the list goes on. Products anyone with an ounce of common sense can see are really designed to thumb their nose at current restrictions because we didn't like them and children want toys they're told they aren't supposed to have. One could easily make the case that today you can buy and legally own more compact firepower than at any time in the last few decades. If the ATF is out to "get us" they are doing a piss poor job of it, even for a government agency.

About a year ago, I wanted to put a compact stock (not a brace) and a vertical foregrip on my SIG MPX, so I spent the $200 and SBR'd it. I had three more items with pistol braces and short barrels (LWRCI SMG45, 300-BLK Pistol, 5.56 Pistol) where I wanted to do the same thing and lose the brace and be able to modify them into SBR form-factors ... but I didn't want to spend $600 just on tax stamps. I get why everyone is pissed, but for me and what I wanted to do, this is a $600 "gift" to me from the ATF. I've already done the eForms and submitted. Don't hate me for getting free SBR upgrades, as that's exactly what I want. Those that choose to fight this ... I'm on your side, more power to you, and I hope you win. What we really need is to throw out the whole NFA and start over with only automatic weapons regulated (IMHO). Regulating suppressors is especially stupid !!!

So either you’re going to owe that money anyway, be guilty of tax evasion, or have to forfeit the firearm because the form 1 is null and void because the tax wasn’t paid.

They absolutely have the authority to waive this fee. They call it a "Tax Stamp" historically, but it's really just a registration fee, and any government authority has the ability to assess or waive fees at will.
